other areas; and the erection, construction, repair and use of build-
ings and other structures; and to enact local laws providing ap-
propriate administrative and judicial proceedings, remedies, and
sanctions for the administration and enforcement of such ordinances
and amendments.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.

CHAPTER 778
(House Bill 474)

AN ACT to repeal and re-enact, with amendments, Section 12(a)
(41) of Article 86 of the Annotated Code of Maryland (1951 Edi-
tion), title "Fees of Officers", sub-title "Clerks of Court", and to
add a new Sub-section (m) to Section 273 of Article 81 of said
Code, title "Revenue and Taxes", sub-title "Recordation Tax",
said new sub-section to follow immediately after Sub-section (1)
thereof, relating to an increased rate of recordation tax on certain
conveyances recorded with the Clerk of the Circuit Court for Mont-
gomery County and by reason of such increase providing for per-
centum of commission to be received by the said Clerk for receiv-
ing, collecting and paying over all public money.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 12 (a) (41) of Article 36 of the Annotated Code of
Maryland (1951 Edition), title "Fees of Officers", sub-title "Clerks
of Court", be and is hereby repealed and re-enacted, with amend-
ments, to read as follows:

12. (a)

(41) For receiving, collecting and paying over all public money—
5% except the Clerk of the Court of Common Pleas and the Clerk of
the Circuit Court for Montgomery County,
who shall receive 3%
commission.

Sec. 2. And be it enacted by the General Assembly of Maryland,
That new Sub-section (m) be and it is hereby added to Section 273
of Article 81 of the Annotated Code of Maryland (1951 Edition), title
"Revenue and Taxes", sub-title "Recordation Tax", said new sub-sec-
tion to follow immediately after Sub-section (1) thereof, to read as
follows:

273.

(m) Montgomery County. The rate of tax applicable to instru-
ments recorded with the Clerk of the Circuit Court for Montgomery
County shall be as follows:
