(5)  The calendar month and year the test was completed to
determine such percentages.

(6)  Name and address of the person who labeled said seed
or who sells, or offers or exposes said seed for sale within
this State.

(b) For containers of less than one pound—

(1)  Name of kind and variety of seed.

(2)   The year for which the seed was packaged or the germi-
nation percentage and date.

(3)  For seed which germinate less than the standard last
established by the State Board of Agriculture under this
sub-title:

(A)  Percentage of germination, exclusive of hard seed.

(B)  Percentage of hard seed, if present.

(C)   The calendar month and year the test was com-
pleted to determine such percentages.

(D)  The words "BELOW STANDARD⁹' in not less than
8-point type.

(4) Name and address of the person who labeled said seed or
who sells, or offers or exposes said seed for sale within
this State.

151A. Each container of flower seeds or tree and shrub seeds
which is sold, offered for sale, or exposed for sale, within this State
for planting purposes shall bear thereon or have attached thereto
in a conspicuous place a plainly written or printed label or tag
in the English language, except when the scientific name is the
commonly accepted name, giving the following information:

(1)  Name of kind and variety of seed.

(2)   The year for which the seed was packaged or the germination
percentage and date.

152. (Prohibitions.) (a) It shall be unlawful for any person to
sell, offer for sale, expose for sale, or transport any agricultural,
vegetable, flower, or tree or shrub seed within this State—

(1)   Unless a permit has been obtained in accordance with the
provisions of this sub-title.

(2)   Unless the test to determine the percentage of germination
required by Sections 150 and 151 shall have been completed within
a 9-month period, exclusive of the calendar month in which the
test was completed, immediately prior to sale, exposure for sale, or
offering for sale or transportation.

(3)  Not labeled in accordance with the provisions of this sub-title,
or having a false misleading labeling.

(4) Pertaining to which there has been a false or misleading
advertisement.
