(House Bill 679)

AN ACT to repeal and re-enact, with amendments, Sub-section 210
(a) of Article 66C of the Annotated Code of Maryland (1951 Edi-
tion and 1956 Supplement), title "Natural Resources", sub-title
"Birds, Game and Inland Water Fish", sub-heading "Regulations
for Taking of Game and Fresh Water Game Fish in Nontidal
Waters", relating to the taking of carp and eels by gigs in the
waters of the Monocacy and Potomac Rivers in Frederick County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 210 (a) of Article 66C of the Annotated Code of Mary-
land (1951 Edition and 1956 Supplement), title "Natural Resources",
sub-title "Birds, Game and Inland Water Fish", sub-heading "Regu-
lations for Taking of Game and Fresh Water Game Fish in Non-tidal
Waters", be and it is hereby repealed and re-enacted with amend-
ments, to read as follows:

210.

(a) Use of fishing rigs other than those permitted in this article
unlawful.—It shall be unlawful for any person to use or attempt to
use a gig or gig iron or a light or nets or seines, fish pots, or other
fishing rigs other than permitted in this article, provided, however,
it shall be lawful to take or shoot carp with bow and arrow under
the supervision, regulation and control of the game and inland fish
commission; provided, however, that the taking or catching of
cyprinus carpio (carp) by gig under the supervision, regulation and
control of the Game and Inland Fish Commission shall be lawful
in the Potomac River, Conococheague Creek, and in Antietam Creek,
all areas being in Washington County, except during the months
of April, May and June. Provided that it shall be lawful to take or
catch carp or eels under the supervision, regulation and control of
the Game and Inland Fish Commission in the Potomac River and the
Monocacy River in Frederick County.
It shall be deemed prima facie
evidence that same was in possession for the purpose of violating this
section. ANY PERSON VIOLATING THIS SECTION SHALL BE
DEEMED GUILTY OF A MISDEMEANOR AND UPON CON-
VICTION SHALL BE FINED NOT LESS THAN ONE HUNDRED
DOLLARS ($100.00) NOR MORE THAN THREE HUNDRED
DOLLARS ($300.00).

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.
