5. And be it enacted, That the said commissioners shall have full
power and authority to enact and pass all laws and ordinances to
preserve, the health of the town, prevent and remove nuisances; to
impose and appropriate fines, penalties and forfeitures, for the
breach of their by-laws or ordinances; to lay and collect taxes for
opening and extending the back and necessary cross alleys of the
said town, provided that the said taxes shall not exceed twenty
cents on every hundred dollars worth of taxable properly in any
one year, which they may collect as county tuxes are collected, by
such persons as the burgess may sec fit to appoint; all ordinances
and by-laws to be signed by the burgess.
6. And be it enacted, That the said commissioners shall lay off
the back alleys of the said town, according to the following direc-
tions: The first hack alley shall commence at the east corner of
Jacob Yingling's lot, and run thence parallel with the main street
of Westminster, sixteen and a half feet wide, until it intersects the
back alley at Winter's Addition to Westminster: the second back,
alley shall begin at the south corner of Thomas Mitten's lot, and
run thence parallel with the main street aforesaid, sixteen and a
half feet wide, until it intersects the road leading from Westmin-
ster to Thomas Wells's mill at the Goose Pond.
7. And be it enacted, That the said commissioners, or a majo-
rity of them, shall have power to appoint their own clerk, and assign
to him his duties, and also to allow him a salary in their discretion
not exceeding the sum of twenty dollars per annum.
8. And be it enacted, That all ordinances parsed by the said com-
missioners shall by their clerk be entered in a book to be kept by
him for that purpose, and shall be open at all times for the inspec-
tion of any person, and copies of said ordinances shall be put up
in the most public plates of said town that the same may be gene-
rally made known.
9. And be it enacted, That all fines and forfeitures under the or-
dinances of the said corporation, shall be recovered before the bur-
gess aforesaid, in like manner as small debts are recovered out of
court.
10. And be it enacted, That the said commissioners shall meet
upon the business of the town at least three times in every year,
and lour commissioners shall make a quorum for the transaction of
business; and if during the year for which they are elected, any
of the six commissioners should die, resign, remove from the said
town, or in any manner become incapable of acting as such, the
remaining commissioners shall till the vacancy so produced, by
choosing and electing some person qualified as is herein before di-
rected, and such person so chosen shall act as commissioner until
the next general election.
11. And be it enacted, That no ordinance of the said corporation
shall impose a fine of more than ten dollars for any offence.
12. And be it enacted, That the burgess, and commissioners
aforesaid, shall take an oath before a justice of the peace of Frede-
rick county, before they proceed to the execution of their several
duties, to act without favour, partiality or affection, in all things
appertaining to their respective trusts.
