CHAPTER 56.
An act for the relief of Elizabeth S. Fitzhugh of the City
of Baltimore.
Sec. 1. Be it enacted, by the General Assembly of Maryland, That
John Fitzhugh, of Calvert county, the present husband of Eliza-
beth S. Fitzhugh of the city of Baltimore. shall from this time for-
ward be, and he hereby is altogether deprived of all and every in-
terest, authority, power and control, in, over, and to the per-
son or property of the said Elizabeth S. Fitzhugh, as fully and en-
tirely as if she had never been married, and that all such interest,
authority, power and control, shall form henceforth utterly cease,
end and determine.
2. And be it enacted, That the said Elizabeth S. Fitzhugh, shall
be, and she is hereby declared capable, to have, hold, take, re-
ceive, sue for and recover, by compromise, suit or suits in law or
equity, property of any kind, whether real, personal or mixed, in
as full and ample a manner as if she was a feme sole, and had never
been married, and to hold, use and enjoy the same, for her own use
and benefit, and the same to dispose of according to her will and
pleasure, without the let, hindrance, molestation, interference or
the consent of her said husband, in as full and ample a manner as if
she was a feme sole, and as if they had never been married; and in
the same manner may in her own mime, and at her own expense,
bring and prosecute suit or suits at law or in equity, to recover da-
mages or recompense for waste, destruction, trespass, or injury of
any kind, done to or committed upon her property, real, personal
or mixed, and to prevent the same, which she might or could bring
or prosecute were she a feme sole, and had the same interest therein,
present or reversionary, which she now hath or hereafter may have.
3. And be it enacted, That the said Elizabeth S. Fitzhugh shall
have full power and authority, from time to time, to enter upon her
lands in which she hath said reversionary interest, for the purpose
of cutting cord wood, and felling timber thereon, and carrying away
the said wood and timber, and selling and disposing thereof, to raise
money for the support of herself and her family, and shall have full
right of ingress, egress and regress, with her workmen, overseers,
oxen, horses, wagons and carts, in, upon, to, at and from the
said lands, for that purpose only: Provided always, that the said
Elizabeth S. Fitzhugh do and shall at all times suffer wood and
timber to be. growing thereon, sufficient to be applied by the tenant
for life, for all necessary uses and wants of the plantations and
buildings thereon.
