2. And be it enacted, That the said commissioners, or a majori-
ty of them, are hereby authorised and empowered, in their discre-
tion, to lay out, mark and bound, a lot of ground at or near to
George Presbury's landing, not less than forty perches long and
four perches wide, along the edge of the water, at low-water mark,
and condemn the same as a public landing for the use of the citi-
zens of Harford county; and the said commissioners, or a majority
of them, are hereby authorised and empowered to lay out and open
a road, to begin at Homo convenient point on the road authorised
to be laid out by the first section of this law, near the upper end
of William Patterson's field next to Doctor Thomas Archer's,
thence on the best direction the nature of the ground will admit
to intersect the. post road, thence in the nearest and best direction,
and with the least possible individual injury, to the aforesaid land-
ing place; Provided, that the said roads shall not be made to pass
through the buildings, yards, gardens or orchards, of any person
or persons, without the consent of the owner or owners thereof
first had and obtained.
3. And be it enacted, That it shall be the. duty of the said com-
missioners, or a majority of them, to cause a plot and certificate
of said roads and landing place, to be. made, out, and returned to
the levy court of Harford comity, whereupon the said levy court
be and they are hereby authorised and directed, to levy upon the
assessable property of the said county such sum of money as they
may deem necessary for opening and clearing said roads, and
shall appoint an overseer or overseers for that purpose; and the
said roads when so opened and cleared, and the building place laid
nut as aforesaid, shall be, and the same is hereby declared to be,
fur ever thereafter, public roads and landing place, and shall be
kept in repair as other public roads in said county.
A. And be it enacted, That the said commissioners, or a majority
of them, shall value and ascertain the damages that may be sus-
tained by any person or persons through whose lands the said
roads may be made to pass, and by opening the landing place
aforesaid, taking into consideration the advantages and disadvan-
tages, (if any) and the damages so ascertained shall be levied and
assessed as other county charges in said county are, and shall be
paid over to the persons respectively entitled to receive the, same;
Provided, that no money shall be levied or assessed for the purpose
of paying the damages to be ascertained as aforesaid until the said
roads and landing place are opened and cleared agreeably to the
provisions of this act.
5. And be it enacted, That the said commissioners before they
proceed to act shall take an oath, or affirmation, before some jus-
tice of the peace, that they will, without favour, partiality or pre-
judice, assess the damages sustained by the persons through whose
lands the. said roads may pass, or the said landing place be opened.
6. And be it enacted, That the levy court of Harford county
shall allow to the said commissioners the sum of two dollars per
day for every day they shall be employed in discharge of the du-
ties required of them by this act, and a like sum for every day
they attended in discharge of the duties required under the act to
which this is a supplement, to be levied, collected and paid, as
other county charges in said county are.
