gate or turnpikes over or upon the same, of any part of the same,
for any term not exceeding seven years, under such rents, reser-
vations and conditions, as the said presidents and managers at any
meeting of their board shall agree upon, which grants and demises
shall have the same construction, force and effect, as other like
grants and demises may between private persons have and receive.
31. And be it enacted, That if by the termination of any of the
said roads, it should so happen that, a fractional part may remain
over and above the even ten miles, measuring from Rockville
aforesaid, that it shall and may be lawful for the said companies,
on the same being completed agreeably to this act, to make appli-
cation to the governor and council, who shall thereupon have the
same examined and licensed as aforesaid to receive tolls, in the
name proportion, on the aforesaid fractional part of the said road,
as is herein before allowed to be received on other parts of the
said road.
32. And be it enacted, That no toll-gate shall be erected within
the distance of one mile from any one of the towns or villages in
this act mentioned.
33. And be it enacted, That it shall and may be lawful for any
corporation or body politic in the United States to become subscri-
bers for stock in said companies, in the same manner as individu-
als may become subscribers and stockholders therein, and transfers
of stock in said companies may be made by corporations or bodies
politic, of their stock in said companies, in such manner as the
said companies shall and may from time to time by their laws ap-
point and direct.
34. And be it enacted, That whenever the new roads shall depart
from the beds of the old roads respectively, it shall and may bo
lawful for the presidents and managers of the said companies res-
pectively, with the consent of the owner or owners of the land
through which the old roads may pass, to shut up the same.
35. And be it enacted, That the said presidents and managers
shall ascertain and value what damages may he sustained by any
person or persons through whose land the said road shall
pass, and the same, when so assessed, shall be paid, or secured
to be paid, before the said president and managers shall pro.
reed to open the said road; Provided always, that if any per-
son or persons through whose land the said road shall pass,
or his, her, or their guardian or trustee, shall conceive them-
selves aggrieved by such valuation and assessment of dama-
ges by the said presidents and managers, it shall and may be
lawful for the said presidents and managers, or any two of
them respectively, to issue their warrant to the sheriff of the coun-
ty aforesaid, commanding him to summon twelve freeholders in the
county aforesaid, and not interested in the premises, and qualified
to serve as jurors in the county court, to appear on a day by them
to be appointed on the premises, and the said presidents and ma-
nagers, or any one of them respectively, are hereby authorised to
administer an oath, or affirmation, as the case may be, to every
person so summoned, that he will, without favour, affection, par-
tiality or prejudice, assess the damages sustained by the person or
persons at whose request such inquisition shall be taken, by reason
of the opening the aforesaid road through his, her, or their land, and
