plot and certificate of said road to be made out and returned to the
justices of the levy court of Kent county; and if the said justices of
the levy court shall be of opinion that the said road has been laid
out a proper width by the said commissioners, then the said plot
and certificate shall he recorded by the clerk of said county; where-
upon it shall and may he lawful for the said justices of the levy
court, to levy on the assessable property of said county, at such
time or times as they may think most convenient to the public, such
sum or sums of money, as they may deem necessary for widening
and straightening the said road, and to appoint and employ an
overseer to widen and straighten and dear said road, agreeably
to the plot and certificate so as aforesaid to be returned and re-
corded; and the said road, when opened or widened as aforesaid,
shall be, and the same is hereby declared to be, forever thereafter
a public road, and shall be kept in repair as other public roads in
said county.
2. And be it enacted, That the said commissioners, or a majori-
ty of them, shall value and ascertain the damages that may be sus-
tained by each and every person through whose lands the said road
may pass, taking into consideration the advantages and disadvan-
tages to each, and return the same assessment, together with the
plot and certificate as above required, to the said justices of the le-
vy court; and if the person or persons through whose lands the said
road shall pass, shall consider themselves aggrieved by the judg-
ment of the commissioners, the party deeming himself so aggrieved
may apply to two justices of the peace of the county, who shall
forthwith issue their warrants to the sheriff of said county direct-
ed, commanding him to summon a jury of twelve impartial men, to
appear before the said justices at some convenient place by the said
justices assigned, to ascertain the damages which he, she or they,
may sustain, and the said justices shall certify the same, under their
hands and seals, to the said commissioners, who shall return the
same to the levy court of said county, and the said justices of the
levy court shall be, and they are hereby authorised, to levy the
amount of said damages on the assessable property of the said coun-
ty, at such time or times, as they may think most convenient for the
public, and the same shall be paid over to the persons respectively
who may be damaged by the widening and straightening of the said
road.
3. And be it enacted, That each of the said commissioners shall
be entitled to receive, as a compensation for his services, every day
he may be engaged in performing the duties required by this act,
a sum not exceeding two dollars per day, the same to he ascertain-
ed by the said justices of the levy court, which is hereby directed
to be levied, collected and paid, as other county levies are.
