either of them, may upon the general issue give in evidence any
matter or thing that could have been well pleaded in bar to the
said action, any law or usage to the contrary in any wise notwith-
standing.
7. And be it enacted, That if any person or persons shall wilfully
and feloniously set fire to, or burn, any part of said bridge, he, she
or they, as the case may he, shall be deemed and taken to he guilty
of arson, and upon being thereof convict shall suffer such punish-
ment as is or may be provided by law for persons guilty of arson.

CHAPTER 154.
An act to Regulate Lotteries.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
in all rases whore lotteries have been heretofore authorised, under
which power is given to raise a particular sum of money by one or
more lotteries, and the managers may have drawn a lottery or lot-
teries, the scheme of which purported to raise the sum authorised
to be raised, that in all such cases the power and authority given
to raise money thereby, he and the same is hereby considered as
completed, and the power to draw any other lottery or lotteries,
under the same authority, he and the same is hereby declared at an
end, and the act authorising the same, is repealed; Provided, that
the prohibition in this section contained shall not extend to the Sur-
gical Institution Lottery, or Medical College Lottery, the prizes
drawn therein to be nevertheless subject to the five per centum by
this act imposed upon all prizes; And provided further, that before
a drawing of any lottery shall be had under the foregoing proviso,
the managers shall give bond, with two or more sufficient securities
to he approved by the treasurer of the western shore, conditioned
fur the payment of the said five per centum into the treasury, at
the expiration of sixty days after the drawing shall be completed;
and the managers of any lottery offending against the provisions
aforesaid, shall forfeit severally the sum of five thousand dollars,
to be recovered by indictment in the county court of the county
where the offence shall be committed, or in the city court of Balti-
more, as the case may be, for the use of the state.
2. And be it enacted, That the managers of all lotteries which
may hereafter he drawn in this state, be and they are hereby autho-
rised and required, to deduct from all prizes in said lotteries five
per centum, in addition to the deduction provided for by the scheme
of said lottery, and within sixty days after the drawing of any
such lottery shall be finished, shall pay over the said five per cen-
tum to the treasurer of the western shore of Maryland, for the use,
of the state, and in case they do not so pay over the said five per
centum, the bonds of said managers shall be put in suit in the coun-
ty where they may reside.
3. And be it enacted, That the governor and council be and they
are hereby authorised and empowered, to appoint and commission
three discreet and good men, to be styled Commissioners of Lotte-
ries, removable at the will of the governor and council, and each
commissioner shall be entitled to receive an annual salary of twelve
hundred dollars, to be paid out of the aforesaid five per cent de-
duction from prizes, and from no other monies, which said salary
