in their power for want of convenient schools, where the rudiments
of such education might be had at a moderate expense;
Sec. 1. Be it enacted by the General Assembly of Maryland, That
the school at Elkton in Cecil county, called "The Town's School,"
shall be erected, and hereby is erected into an academy, for li-
beral education of youth in such sciences and brandies of learning
as the trustees and professors thereof shall from time to time think
useful and expedient for the benefit and advancement of the insti-
tution; and the said academy shall be regulated under the manage-
ment, direction and government of twelve, trustees, and be perpetu-
ated in the manner herein alter mentioned.
2. And be it enacted, That James Sewall, John Groome, Tobias
Rudolph, William H. Ward, Adam Whann. Joshua Richardson,
Levi Tyson, John Ruan, John R. Evans, Thomas W. Veasy,
Alexander Scott, and Matthew Pearce, be and they are hereby ap-
pointed trustees of the said academy; and the said trustees, and
their successors, to be elected in the manner hereinafter mentioned,
shall be, and they are hereby elected, established, and declared to
be, one community, corporation, and body politic, with perpetual
succession, in deed and in law, to all intents and purposes con-
nected with the, said institution, by the name and style of "The,
Elkton Academy in Cecil County," by which name and title, they,
the said trustees, and their successors, shall be competent and ca-
pable, in law and in equity, to take, and to hold to themselves and
their successors, for the use of the said academy, any estate, in any
messuages, lands and tenements, annuities, goods, chattels, monies
or effects, by the gift, grant, bargain, sale, conveyance, devise or
bequest, of any person or persons whatsoever, provided the same
do not exceed in the whole the clear yearly value of five, thousand
dollars; and the. same messuages, lands and tenements, and other
estate real or personal, to farm let, or put out at interest for the
use of the said academy, in such manner as to them, or a majority
of them, shall seem most beneficial to the institution, and to receive
the rents, issues, profits, income, and interest, of the same, and to
apply the emolument thereof to the proper use and advancement
of the said academy.
3. And be it enacted, That the, said trustees, and their successors,
shall be, and they are hereby declared to be, seized in fee simple, for
the use. and benefit of the said academy, of the houses and lot in the
town of Elkton at present belonging to the aforesaid "Town School,"
together with any other property, real or personal, which hath been
given or granted by any individual or individuals for the benefit of
said school.
4. And be it enacted, That at all times forever hereafter when any
vacancy or vacancies shall happen in the said community of trus-
tees, by the death, resignation, or refusal of any one or more of the
members thereof, or by the wilful neglect of any one or more of
them to attend the meetings of the board of trustees for the space
of two years, the remaining trustees, or a majority of them, shall
with all convenient speed, proceed to elect, by ballot, other sensi-
ble, and discreet person or persons of the state, of Maryland, to be
trustee or trustees to supply such vacancy or vacancies, and in like
manner shall all future vacancies be supplied by the said trustees, and
their successors, or a majority of them, so as to perpetuate the num-
ber of twelve persons as trustees of the said academy for ever.
