or tickets in said lottery or lotteries, give their bond to the state of
Maryland, in the penalty of sixty thousand dollars, conditioned
that they will well and truly apply so much money arising there-
from, within nine months after the drawing of said lottery or
lotteries shall be completed, as will satisfy the fortunate adven-
turers for prizes drawn by them, and after deducting the neces-
sary expenses incurred in said lottery or lotteries, shall apply the
money raised by such lottery or lotteries towards repairing said
college, and raising a fund fur the purpose of paying the salaries
of the tutors thereof.
2. And be it enacted, That before the visitors and governors
aforesaid, or a majority of them, proceed to act, the said bond
shall be lodged in the office of the clerk of Kent county, to be
there recorded, and upon such bond, or any certified copy thereof
by the clerk of the county aforesaid, suit or suits may be insti-
tuted for any breach or non-compliance with the condition thereof.

CHAPTER 90.

An act authorising a Lottery for raising a sum of money to
build an Impartial Academy and Free Church in or
near Taney-Town, in Frederick County.
Sec. 1. Be it enacted by the General Assembly of Maryland,
That John M'Killip, John Shorb, Nicholas Snider, Samuel Thomp-
son, James Drummond, David Kephard, Dr. William B. Hebbard,
Samuel S. Forney, John M'Kaleb, C. Burnie, Thomas Jones and
Joseph Sim Smith, or a majority of them, be and they are hereby
authorised to propose a scheme of a lottery, and to sell and dis-
pose of tickets therein, for raising a sum of money not exceed-
ing five thousand dollars clear of expenses, to be appropriated to
the building in or near Taney-Town, in Frederick county, an acade-
my or school house, and place of Divine worship, in the English
language, under the title of The Impartial Academy and Free
Church.
2. And be it enacted, That before the said John M'Killip, John
Shorb, Nicholas Snider, Samuel Thompson, James Drummond,
David Kephard, Dr. William B. Hebbard, Samuel S. Forney, John
M'Kaleb, C. Burnie, Thomas Jones, and Joseph Sim Smith, pro-
ceed to make sale of any ticket or tickets in the said lottery, they
shall give and execute a bond to the state of Maryland, in the
penalty of ten thousand dollars, conditioned that they will well
and truly conduct the drawing of said lottery, and apply the
money arising therefrom, within six months after the drawing
thereof, to the payment of the prizes drawn therein, to the ad-
venturers to whom they shall be due, and the necessary expenses
incurred in the management thereof, and the residue to the build-
ing an academy or school house and free church, in or near Ta-
ney-Town, in Frederick county.
3. And be it enacted. That the said bond shall be lodged in the
office of the clerk of Frederick county court, to be there record-
ed, and upon such bond or any office copy thereof, suit or suits
may be instituted for any breach or non-compliance with the con-
dition thereof.
4. And be it enacted, That the managers aforesaid, or a ma-
jority of them, be and they, or any person or persons appointed
