lished for the information of the citizens: The mayor and corpo-
ration of the town of Frederick, the judges and clerks of the
elections, and all other officers of the town, before they enter up-
on the execution of their respective offices, shall severally take
the following oath, or affirmation: "I do solemnly swear, (or af-
firm, as the case may be) that I will faithfully execute the office
of ------to the best of my knowledge and ability, without favour,
affection, or partiality."
12. And be it enacted, That the person or persons appointed
to collect any tax imposed in virtue of the powers granted by this
act, shall have authority to collect the same, by distress and sale
of the goods and chattels of the person chargeable therewith, but
no sale shall be made unless ten days previous notice thereof be
given; and if the tax imposed shall be chargeable on any real
property, and no goods or chattels can be found liable to be dis-
tressed therefor, the same may be recovered by action or attach-
ment, in Frederick county court, in the name of the mayor, al-
dermen, and common council of Frederick; and where any such
action shall be brought, the mayor, aldermen, and common coun-
cil of Frederick, may declare generally for money hud and re-
ceived to the use of the mayor, aldermen, and common council
of Frederick, and give this law and the special matter in evi-
dence; the said tax to be and remain a lien on the real property
so taxed, until the tax is paid.
13. And be it enacted, That a register for the town shall he
annually elected by the joint ballot of the board of aldermen and
common council; that the duties of the register shall and may
from time to time be fixed and ascertained by ordinance or or-
dinances of the corporation.
14. And be it enacted, That one or more constables may be ap-
pointed for the said town, in such manner as may be directed by
ordinance of the said corporation, who shall have all the power
and authority of constables within the limits of the corporation,
except in the case of small debts; and that all other officers of
the corporation not herein named, which may be deemed neces-
sary to execute the laws of the corporation, shall be appointed
in such manner as shall by ordinance be directed, and shall, as
well as the mayor and other officers named or mentioned in this
law, receive such fees as shall be fixed by ordinance of the cor-
poration.
15. And be it enacted, That the aldermen and common council may

by ordinance, from time to time, as often as they think it neces-
sary, cause a correct survey of the said town, and the additions
thereto, to be made, and to establish and fix permanent bounda-
ries and stones, at such places as they think necessary, with pro-
per marks and devices thereon, to ascertain and perpetuate the
lines of said town, and the additions thereto; and also be au-
thorised, from time to time, to. survey and ascertain the wards,
streets, lanes, alleys, and lots of the said town, and the additions
thereto, and to declare the same, and to adjudge as nuisances
any encroachment on the streets, lanes or alleys, and to cause
the same to be removed at the expense of the person offending ;
and the survey of the said town, and the additions thereto, and
of the wards, streets, lanes, alleys and lots thereof, when made,
