given at least ten days notice in one or more of the public papers of
Baltimore, shall at any time, before the first day of May next, first
being duly sworn, proceed to assess and value what damages will
be sustained by any person or persons whomsoever, by reason of
extending the aforesaid street, taking all benefits and inconveni-
encies into consideration, and shall also declare what sum of mo-
ney each individual, benefitted thereby, shall respectively contri-
bute and pay towards compensating the person or persons injur-
ed by the opening and extending the said street; and the names
of the person or persons, and the sums of money which they shall
be respectively obliged to pay, shall be returned, under the hands
and seals of the commissioners appointed as aforesaid, to the re-
gister of the city, to be filed and kept in his office; and the per-
son or persons benefitted by the opening and extending said
street, shall respectively pay the sum or sums of money so as-
sessed and charged to him, her or them, with interest thereon,
at the rate of six per cent, for the time limited for the payment
thereof.
2. And be it enacted, That the city commissioners be and they
are hereby empowered, to open and extend the said street from
the point of its intersection with High-street, in a straight direc-
tion, until it intersects Jones'-street, and thence in a straight di-
rection to Jones' Falls; and the said street when so opened and
extended, and when the valuation and assessment herein before
directed to be made shall have taken place, shall be deemed and
taken, and is hereby declared to be, a public street and highway
for ever thereafter; and the said city commissioners are hereby
required to return a plot, ascertaining the limits and extent of the
said street, when so opened and extended, to the register of the
city of Baltimore, who shall receive and file the same as part of
the plot of the city of Baltimore; and in case the obstructions
in the said street are not removed within thirty days after the
nancy charged and assessed as aforesaid is paid or tendered, the
city commissioners aforesaid are hereby authorised and directed
to remove the same without delay, and to charge the expenses
of such removal in proportions among the several persons bene-
fitted by the opening and extending of the said street, according
to the benefit which they may have been estimated to have re-
ceived agreeably to the assessment and valuation aforesaid.
3. And be it further enacted, That the said street shall not be
extended or opened through the property of any individual injur-
ed thereby, until the damage by them sustained, and assessed as
aforesaid, shall be first paid, or secured to be paid, to their en-
tire satisfaction, together with legal interest thereon, from the
time at which payment is limited to be made, and shall remain
a lien thereon.
4. And be it enacted, That it shall be the duty of the city col-
lector of Baltimore to collect the damages and expenses that
shall be assessed by the commissioners to be appointed by the
mayor of said city, in the same manner that the city taxes
are directed to be collected, or in case of neglect or refusal to
pay, by a public sale of the property ascertained as aforesaid to
be benefitted by the opening of said communication, or so much
thereof as shall be necessary, of the person or persons so neg-
