ry or lotteries, and to sell and dispose of the tickets thereof, :
and to draw the same; Provided, that the said William Beanes,
John Read Magruder, Trueman Tyler, John Hodges (of Thomas)
Henry Ashton, Thomas R. Hodges, and William B. Beanes, or
a majority of them who undertake to act under this law, before
the sale or disposal of any ticket or tickets in said lottery or
lotteries, give their bond to the state of Maryland, in the penalty
of forty thousand dollars, conditioned that they will well and tru-
ly apply so much money arising therefrom, within sixty days af-
ter the drawing of the said lottery or lotteries he completed, as
will satisfy the fortunate adventurers for prizes drawn by them ;
and shall, within three months after the drawing of the said lot-
tery or lotteries be completed, pay over to the Philomanthanean
Society of Upper Marlborough, the money tints raised, to be by
them applied, within one year after the drawing of the said lot-
tery or lotteries shall be completed, to the purchase of a public
library, and the establishment and endowment of a free school in
Prince George's county.
2. And be it enacted, That it shall be the duty of the said mana-
gers, before they act as such, to lodge the bond entered into as
aforesaid in the office of the clerk of Prince-George's county,
there to he recorded, and upon such bond, or any office copy
thereof, suit or suits may be instituted against the obligors there-
in, or any of them, or their legal representatives, for any breath
or non-compliance with the same.
3. And be it enacted, That the said managers he and they, or
any person or persons appointed by them, are hereby authorised
to dispose of and sell all or any of the tickets of the said lottery
or lotteries in the city of Baltimore, or any part of this state,
exclusive of any controul over the same by the corporation of
the city of Baltimore, any law or usage to the contrary notwith-
standing.

CHAPTER 260.

A Supplement to the act, entitled, An act to Incorporate a
Company to open the Navigation of Zachia Run.
Whereas, several of the persons named as commissioners in
the act to which this is a supplement, have died and removed
from Charles county, before the commencement of the operations
authorised by the said act, and it being found inconvenient to
procure the attendance of a majority of the commissioners for
the purposes designated therein, and it being also discovered
that the sum to be raised by lottery would be insufficient for the
object intended to be effected thereby; to remedy which,
Sec. 1. Be it enacted by the General Assembly of Maryland,
That William Penn, Edward Edelin, Joseph Barker, Raphael
Boarman, be appointed in the place of Jesse Jameson. Smith
Hardkin, and Joseph Simpson, deceased, and of John B. Mor-
ris removed, and that any five of the whole number of the com-
missioners shall have full power and authority to do and perform
all matters and things which might or could be done by the whole
of the said commissioners, or a majority of them, and that upon
the death, resignation, or removal out of Charles county, of any
one of the commissioners aforesaid, or upon his declining to act,
