Compensation.

Harford county court, to be by him recorded; Provided always,
that the said road shall not be made to pass through the build-
ings, gardens or orchards, of any person or persons, without the
consent of the owner or owners thereof.
2. And be it enacted, That the levy court of Harford county
be, and they are hereby directed, upon the plot of such road be-
ing returned to the clerk's office of said county, to levy such sum
of money as they, in their discretion shall deem necessary, for
opening and making conveniently passable the said road, and
shall appoint an overseer or overseers for that purpose; and the
said road shall thereafter be deemed a public highway, and shall
be kept in repair another public roads in said county are.
3. And be it enacted, That the said commissioners, or a majori-
ty of them, shall value and ascertain the damage that may be
sustained by each individual through whose land the said road
may pass, taking into consideration the advantages and disad-
vantages, (if any) and return the same to the levy court, toge-
ther with the plot and certificate as above directed; and the dama-
ges so ascertained shall be levied and collected as other county
charges in said county are, and shall be paid over to the persons
respectively entitled to receive the same; Provided nevertheless,
that no money shall he levied or assessed for the purpose of pay-
ing the damages aforesaid until the said road is opened and clear-
ed agreeably to the directions of this act.
4. And be it enacted, That the. said commissioners shall be en-
titled to receive as a compensation for their services in perform-
ing the duties required by this act, the sum of two dollars per
day, to be levied, collected and paid, as other county charges in
said county, are.

CHAPTER 267.

Ah act to continue in force the Acts of Assembly which,
would expire with the present Session.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
all such acts, and parts of acts of assembly, (except the act, en-
titled, An act to authorise the several banks in this state to issue
small notes for a limited time, and for other purposes,) as would
expire with the present session, be and the same are hereby con-
tinued until the twentieth day of November next, and until the
end of the next session of assembly which shall happen thereaf-
ter.

CHAPTER 268.

All act authorising a Lottery or Lotteries for the purpose
of purchasing a Public Library, and establishing and
endowing a Free School in Prince-George's County.
Sec. 1. Be it enacted by the General Assembly of Maryland,
That it shall and may be lawful for William Beanes, John Read
Magruder, Trueman Tyler, John Hodges, (of Thomas) Henry
Ashton, Thomas R. Hodges and William B. Beanes. or a majo-
rity of them, to propose a scheme or schemes of a lottery or lot-
teries, to raise a sum of money not exceeding twenty thousand
dollars clear of all expences incurred in drawing the said lotte-
