whether the said road is so far executed in a masterly and work-
manlike manner, according to the true intent and meaning of
this act, and if their report shall he in the affirmative, then the
governor shall, by license under his hand, and the seal of the
state, permit and suffer the president, managers and company,
to erect such and so many gates or turnpikes upon or across the
said road, as will be necessary to collect the tolls granted to the
said company, from all persons travelling on the same, with
horses, cattle, mules, wagons, carts or carriages.
13. And be it enacted, That if the legislature of Maryland
shall, at any time after the year 1845, think proper to take pos-
session of said road for the purpose of declaring it a free road,
six persons shall he appointed by the governor of this state, and
six by the said company, who, or a majority of whom, not hav-
ing an interest in said road, shall estimate the value of the pro.
perty which said company have therein; and whenever the
amount so estimated shall be paid to the said company, their
right to toll on said road, and all their right, title and interest
therein, shall cease.
14. And be it enacted, That the commissioners herein named,
shall appoint five commissioners to locate and survey the said
turnpike road, and to exhibit a plot thereof at the time of open-
ing the books of subscription for the said capital stock.
CHAPTER 223.
An act authorising Marsham Parker, late Sheriff of Cal-
vert County, to complete his collection.
Sec. 1. Be it enacted by the General. Assembly of .Maryland,
That the said Marsham Parker be, and he is hereby authorised to
collect, until the first day of January, eighteen hundred and
eighteen, all balances due him as sheriff and collector of Calvert
county, in the same manner as he could or might have done within
the time limited by law, any law to the contrary notwithstanding.
2. And be it enacted, That it shall be the duty of the said
Marsham Parker, before he proceeds to execute or distrain the
property of any person or persons for officers fees, or public dues,
in virtue of this act, to deliver to such person or persons charge-
able with the same, at least thirty days previous to levying such
execution or distress, an account, written in words at full length,
of the officers fees or public dues demanded of him, her or them,
with an affidavit annexed, if required, that he hath not received
any part thereof, nor any thing as security or satisfaction for the
same, more than credits given, to the best of his knowledge.
3. And be it enacted, That the said Marsham Parker before he
derives any benefit from or under this act, shall lodge his collec-
tion books in the clerk's office of Calvert county, to be opened
for the inspection of all persons interested in the same.
