majority of such number of them as are disposed to act under
this law, be and they are hereby authorised to propose a scheme
or schemes of a lottery or lotteries, and to sell and dispose of the
tickets as well in the city of Baltimore, as in any other part of
the state, clear of taxes, any law to the contrary notwithstanding,
for raising a sum of money not exceeding thirty thousand dollars
over and above all expenses and commissions allowed on sales of
tickets, and expenses of drawing said lottery or lotteries, for the
purpose of purchasing a lot of ground, and erecting thereon a
Masonic Hall for Washington Lodge, No. 3, in that part of the
city of Baltimore known and distinguished by the name of Fell's
Point.
2. And be it enacted, That before the said Tobias E. Watkins,
Peter Little, William If. Winder, George Winchester, Sheppard
C. Leakin, George Myers, John Berry, George Keyser, Stephen
H. Moore, Henry Dorry, James Cordery, James Vinson, Tho-
mas Worrell and Jacob Bier, or such others its may he appointed
as herein after provided, proceed to make sale of any ticket or
tickets in said lottery or lotteries, they shall give bond in the pe-
nalty of sixty thousand dollars, conditioned that they will well
and truly conduct the drawing of said lottery or lotteries, and
within sixty days after the drawing thereof, apply so much of
the money arising therefrom, as may be necessary to the payment
of the prizes drawn therein to the adventurers to whom they
may be due, and the. necessary expenses incurred in the manage-
ment thereof, and conditioned also for the faithful application of
the sum received by them out of the said lottery or lotteries, to
the uses and purposes herein before mentioned, and according to
the true intent and meaning of this act.
3. And be it enacted, That the said bond shall be given to and
in the. name of the state of Maryland, and lodged in the office.
of the clerk of Baltimore county, and upon said bond, or
an authenticated office copy thereof, suit or suits may be institut-
ed for any breach or non-compliance with the condition thereof.
4. And he it enacted, That upon the refusal or neglect of any
of the above named managers to execute the trust in him or them
reposed, the vacancy may be filled by the master and wardens of
Washington Lodge, No. 3.

CHAPTER 187.

An act relating to Writs of Certiorari in the cases there-
in mentioned.
Sec. 1. Be it enacted by the General Assembly of Maryland,
That upon the allowance of any writ of certiorari for the removal
of the proceedings by justices of the peace, under the act of se-
venteen hundred and ninety-three, chapter forty-three, for the
speedy recovery of lands and tenements, and also in all cases of
inquest for a forcible entry and detainer, or a forcible detainer,
the party obtaining the said writ of certiorari, shall give bond,
with security, to the opposed party, to be approved by the judge
or court allowing such writ, in such penally as said judge or
court shall direct, conditioned for the payment of all costs and
damages that may he incurred or suffered by the delay of the
