ments, or tax on the real property of non residents, in case
here be not personal property therein, shall be collected out of
rents of such property by attachment, in the nature of a fi.
fa. against rights and credits, and until such assessment or tax
shall be paid, the same shall remain a lien upon the property,
subject to interest at the rate of six per centum per annum.
9. AND BE IT ENACTED, That the bailiff of the raid
town shall be appointed annually in the month of May, and
before he shall proceed to execute his office he shall take an
oath, or affirmation, before the said commissioners, that he
will faithfully and impartially perform the duties required of
him as bailiff of the said town and precincts, by this act, accor-
ding to the best of his skill and judgment, and without favor,
affection or prejudice; and the duties of the said bailiff shall be
to attend the meetings of the said commissioners whenever he.
shall be required, to perform such services for more effectually
accomplishing the objects of this act, as shall be directed by the
said commissioners, to prevent the tumultuous and irregular
meetings of slaves, negroes, and other dissolute and disorderly,
persons within the limits of the said town and precincts, or if
so assembled, to disperse them by reasonable and lawful
means, and to punish with moderate correction, under such
rules and regulations as shall he prescribed by the said com-
missioners, all such negro and other slaves, as shall be found
wandering or strolling about the streets in the night time, or
frequenting the houses of other persons in the said town or pre-
cincts, without the permission or consent of their masters,
mistresses or overseers.
10. AND BE IT ENACTED, That the same powers giv-
en to the justices of the peace in any county within this state
by an act of assembly passed at November session seventeen
hundred and eighty seven, entitled, an act to regulate the as-
sise of bread, shall be and they are hereby vested in the com-
missioners to be exercised by them within the said town only.
11. AND BE IT ENACTED, That it shall not be lawful
for any person or persons to keep or raise any swine within the
limits of the said town or precincts, except in pens or other
enclosures, and if any swine shall be found going at large
within the said town or precincts, belonging to any inhabitant
of the said town or precincts, it shall be lawful for the bailiff of
the said town, upon the information of the inhabitants thereof,
or upon his own view, to distrain and seize all and every such
swine, and to secure the swine in some common pound to be
provided by the said commissioners for that purpose, and all
and every such swine so distrained and secured, shall be for-
feited for the benefit of the said town, and shall be sold at pub-
lic auction to the highest bidder, and the profits arising from
the sale thereof, (excepting one third of the amount to be re-
tained by the said bailiff for his trouble,) shall be accounted
for, and rendered by the bailiff to the said commissioners, to be
applied by them for the uses and benefits of the said town and
precincts; and moreover, every person who shall keep or raise
any swine, except in pens or enclosures, or shall sutler any
such swine to go at large within the said town and precincts,
shall forfeit and pay the sum of two dollars for every swine so
kept or raised, or going at large, contrary to the provision of
this act.
