10. AND BE IT ENACTED, That if said company do
not proceed to carry on said work within two years after
the passing of this act, or shall not within ten years thereafter
complete the said road, it shall be lawful for the legislature of
this state to resume the rights, privileges, liberties and franchi-
ses, granted by this act to said company.
11. AND BE IT ENACTED, That the county courts of
Frederick and Washington counties, shall appoint five com-
missioners, who shall estimate the amount of damages sus-
tained by any person or persons by reason of said road pass-
ing through his, her, or their land, or by taking stone, gravel,
or other materials, for the use of said road, in cases where the
parties cannot agree, which estimate shall be final in determine

ing such damages.
12. AND BE IT ENACTED, That it shall and may be
lawful for the managers of the turnpike road aforesaid, or a
majority of them, to propose a scheme or schemes of a lottery
or lotteries, for raising a sum of money not exceeding fifty
thousand dollars, clear of all expences in drawing said lottery
or lotteries, and to dispose of the tickets thereof; Provided,
that the said managers, or a majority of them, shall, before the
sale or disposal of any ticket or tickets in said lottery or lotte-
ries, give their bond to the State of Maryland, in the penalty of
one hundred thousand dollars, conditioned that they will well
and truly apply so much of the money arising therefrom, with
in six month's after the drawing of the said lottery or lotteries,
as will satisfy the fortunate adventurers for prises drawn by
them, and shall place the money raised by such lottery or lot-
teries in the hands of the treasurer of said company, to be ap-
plied by the said company to the paving of the road from Fred*
erick Town to Harper's ferry aforesaid.
13. AND BE IT ENACTED, That it shall be the duty of
the said managers before they act as such, to lodge the bond,
entered into as aforesaid, in the clerk's office of Frederick
county, there to be recorded, and upon such bond, or any office
copy thereof, suit or suits may be instituted against the obligors
therein mentioned, or any of them, or their legal representa-
fives, for any breach or non-compliance with the conditions of

the same.
14. AND BE IT ENACTED, That the managers afore-
said be, and they or any person appointed by them, are hereby
authorised to dispose of and sell all or any part of the tickets
of said lottery or lotteries, in any part of the state, and in the
city of Baltimore, exclusive of any control of the same by the
corporation of the city of Baltimore, any law or usage to the
contrary notwithstanding.
15. AND BE IT ENACTED, That the stockholders in
said company shall not be entitled to a per centum on the mo-

ney raised by lottery.
16. AND BE IT ENACTED, That in all cases where no-
tice in a public news paper is required by the law to which this
has a reference, notice snail be given in some paper in Freder-
ick instead of George Town.
17. AND BE IT ENACTED, That all laws heretofore
passed vesting a power in the Baltimore and Frederick Town
turnpike road company to pave the said road to Harper's ferry
as well as to form a scheme of a lottery or lotteries, and dis-
