Baltimore county court, in liber W. G. No. 100, folio 140, and
upon the receipt of the purchase money to convey the said
right, title and interest to the purchaser or purchasers.
2. AND BE IT ENACTED, That the said Joseph B.
M'Kean be, and he is hereby authorised and directed to invest
the money arising from the sale of the said real estate when
received, in stock of some banks of this state, or in stock of
the United States, and that before he proceed to make the said
sale in virtue of this act he shall enter into bond to the said
minors, in the penalty of ten thousand dollars, with two secu-
rities to be approved of by the orphan's court of Baltimore
county, and lodge the same with the register of the said court,
with condition that he will well and truly perform and fulfill
the trust reposed in him by this act, and account with and pay
to the said minors respectively, when they shall be entitled to
receive their respective proportions of the principal sum of
money and interest which he shall receive by virtue of the.
powers vested in him by this act.

CHAPTER 146.
An act to lay out and open a road therein mentioned in Cecil
County.
Sec. 1. BE IT ENACTED by the General Assembly of
Maryland, That the justices of the levy court of Cecil county
be, and they are hereby authorised, upon the application of a
number of the inhabitants of said county, if the said court up-
on consideration of all circumstances shall be of opinion that
such a road would be of public utility, to appoint live commis-
sioners to survey, lay out and open a road in Cecil county,
from the fishery of Mary M'Leary on the river Susquehanna, in
as straight a direction as the nature of the ground will admit
of, to the public road leading from Port De Posit to Wallaces
mill, and with as little injury to the individuals over whose
land the same may pass as may comport with the public con-
venience; Provided, the said road shall not be laid out through
the garden, yard, meadow or orchard of any person or per-
sons wit tout his her or their consent in writing, first had and
obtained; and a plot of said road when surveyed, confirmed
and laid out, together with, a certificate of the courses of the
same, shall be returned to the clerk's office of Cecil county,
there to be recorded.
2. AND BE IT ENACTED, That when the plot of said
road shall have been confirmed and recorded as aforesaid, it
shall and may be lawful for the levy court to levy upon the as-
sessable property in said county, a sum of money such as they
shall deem necessary under all circumstances, and to appoint
an overseer to open and clear said road, agreeably to the plot
and certificate aforesaid, who shall give bond in like manner as
other overseers of public roads are directed to give bond, and
shall have the same allowance; and the said road when open-
ed and cleared as aforesaid shall be, and the same is hereby de-
clared to be forever thereafter a public road, and shall be kept
in repair as other public roads in said county.
3. AND BE IT ENACTED, That the said commission-
ers respectively, when named by the levy court as aforesaid,
shall be entitled to receive two dollars for every day they shall
severally attend to discharge the duties required by this act,
