partiality or prejudice; and a certificate of such qualification
shall be made out. and returned by such justice of the peace to
the said commissioners, to be filed and recorded among their
proceedings.
5. AND BE IT ENACTED, That if any vacancy shall
happen in the office of one or more of the commissioners, by
death, resignation, or otherwise, it shall be lawful for the re-
maining commissioners, and they are hereby required, to cause
an election to be made at the court house in said town, by all
persons qualified to vole as aforesaid, for one or more persons,
resident as aforesaid, to supply every such vacancy during the
remainder of the term, and the time of holding such interven-
ing election shall be notified for the space of ten days preceed-
ing the election.
6. AND BE IT ENACTED, That the said commissioners
shall be and they are hereby authorised and required, to meet
at the court house in the said town, or some other convenient
place, as often as they or a major part of them may think ne-
cessary, and from time to time to ordain and organise such
plans and regulations as they shall judge beneficial to the town,
or the inhabitants thereof; to cause to be removed all nuisances
and obstructions that may interrupt the passage of the said in-
habitants or others, in the streets, lanes and alleys of the said
town; to cause the streets to be repaired and improved, and to
provide means for those salutary purposes, and shall make
such by-laws for the good government of said town and the in-
habitants thereof, and to restrain all disorders and disturban-
ces, and to prevent all nuisances and annoyances within the
the said town, and other matters, exigencies and things within
said town, as to them or a majority of them shall seem
meet and consonant to reason, and not contrary to the consti-
tution and laws of the state; and such by laws and regulations
shall be observed and performed by all the inhabitants of said
town and others under such reasonable penalties fines and for-
feitures as shall be imposed by the said by laws; the said penal-
tics, fines and forfeitures, to be levied by distress and sale of
the goods, or execution of the person so offending, and applied
to the uses of the said town; to appoint and qualify a clerk,
whose duty it shall be to keep fair and faithful minutes of their
proceedings, and to be subject to the inspection and examina-
tion of the inhabitants of said town, who are authorised by
this act to vote for commissioners in said town; to cause a fair
assessment and valuation of all the property, real and person-
al in said town to be made out and returned from time to time
by some skilful and discreet person to be by them appointed
and qualified for such occasion; and when it shall be deemed
necessary for any purpose beneficial to the town, to impose and
levy on the property so directed to be assessed and valued, any
sum or sums of money in equal and fair proportions; Provided,
the money to be imposed and levied shall not exceed in any
one year the rate of one dollar for every one hundred dollars
worth of property, according to such respective assessments
and valuation, and in the same proportion upon every greater
or smaller share of property; to appoint and qualify an active
and discreet person annually, under satisfactory security, to be
the bailiff of the said town, and to give such directions in the
execution of his office as shall be necessary to accomplish the
intentions of this act; to pay their clerk and the bailiff of the
