Preamble.

ble.

CHAPTER 38.

An act relative to cases in the Court of Appeals.
WHEREAS, the court of appeals at their late session,
in consequence of the indisposition of counsel, and lor
certain other causes found it necessary to fix upon the
second Monday in June next, to meet by adjournment
for finishing the busmen: And whereas, in consequence
of that period being subsequent to the last Monday of
May. it may be doubted whether the said court will have
power at that time to receive and grant any motion for
further argument, or other matter relative to any ap-
peal on which they decided, ami which might have been
heard and granted during the said term, had the court
continued in session, as they would have done had it not
been for the causes aforesaid.

ding may be
considered and
acted upon.

Sec. 1. BE IT THEREFORE ENACTED by the
General Assembly of Maryland, That the said court of
appeals when they shall next meet for the decision of the
unfinished business, shall have full power and authority to
receive and act upon any motion or petition, which shall be
made or presented to them, relative to any of the said ap-
peals which were depending before them at their last ses-
sion, in the same manner as if such motion had been made,
or petition presented, during the said session, and before
their adjournment.

CHAPTER 39.

Passed Jan.

14, 1815.

A supplement to the act entitled, an act to establish a
bank in the city of Baltimore, to be called the City Bank
of Baltimore."

Dividends may
be paid.

Sec. 1. BE IT ENACTED by the General Assem-
bly of Maryland, That the directors of the City Bank of
Baltimore or a majority of them, are hereby authorised
and empowered, at their discretion, to pay to such of the
stockholders of said bank, or to any of them, as may have
failed to pay into said bank any instalment or instal-
ments demanded or required by the provisions of the act to
which this is a supplement, such dividend or dividends
upon the money actually paid into said bank by such
stockholder or stockholders, as such stockholder or stock-
holders would have been entitled to, provided said in-
stalment or instalments had not been demanded or re-
quired; any thing in the said original act to the contrary
notwithstanding.

CHAPTER 40.
