of such application; and if the said occupier or occupiers
will not then permit such chimney to be swept or will not
appoint a time within twenty four hours thereafter for the
sweeping of the same, or will not permit such chimney to
be swept at the time which may bo so appointed, he, she or
they shall pay to the superintendant, the same sum of mo-
ney as if such chimney had been swept by him.

6. AND BE IT ENACTED, That no superintendant

licensed as aforesaid shall demand or receive from any per-
son or persons directly or indirectly for his services any
other or greater fee or rate, than are herein allowed, under
the penally of five dollars for every such offence, to wit :
For a chimney of one story, eight cents; of two stories
twelve and a half cents; three stories, fifteen cents; four
or more stores eighteen cents; and if any chimney in the
said precints shall take fire and blaze out at the top, the su-
perintendant within whose district the said chimney may
be, shall forfeit and pay to the commissioners ten dollars

Proviso.

Provided nevertheless, That such forfeiture shall be paid
by the occupier or occupiers of the house or room wherein
such chimney may be, in case he, she or they would not
permit such chimney to be swept upon application being
made as required by this act.

Compensation
of commissi-
oners & their
clerk.

7. AND BE IT ENACTED, That the commission-
ers shall be allowed two dollars per day, and their clerk
two dollars day for every day they may attend to the
discharge of the duties required of them by this act, and
the clerk shall be allowed six per cent out of all monies
collected by him under this act; and all monies to be col-
lected under the provisions of this act, except one and for-
feitures, shall be recovered as directed by the eighth sec-
tion of the law to which this is a supplement.

Application of
fines.

8. AND BE IT ENACTED, That all fines and pe-
nalties hereby imposed, shall be recovered and applied as
directed in the seventeenth section of the act to which this
is a supplement.

CHAPTER 96.

An act for the relief of Joan Landreth of Somerset
county.
SEC. 1. BE IT ENACTED by the General Assembly
of Maryland, That the judges of Somerset county court,
or any one judge thereof, be and they are hereby autho-
rised and directed to order the body of the said John
Landreth to be released from imprisonment in the jail of
Somerset county on any execution or other process now
issued, or which may hereafter issue from Somerset
county court, or may be issued by any justice of the
peace, on any judgment now obtained, or which may
hereafter be obtained by any creditor of the said John
Landreth, on any debt which shall have existed prior to
the application of the said Landreth for the benefit of the
