2. AND BE IT ENACTED, That the said Christo-
pher Hughes and other proprietors of the said lots shall
leave open on the south side of the said line extending
eastwardly in a right line with and from the north side

of Lee street aforesaid, between the waters of the said
Basin of Baltimore, and the buildings and improvements
to be made by them, a space of the width of fifty-feet
running eastwardly from Forest street to Johnson street,
which space and also the said continuations of William
and Johnson streets, and the said street called Quay
street of the width aforesaid, and extending from Forrest
street to Johnson street, shall ever remain open as com-
mon highways, streets and thoroughfares; hut the said
Christopher Hughes and others the proprietors of the
said lots and wharves, shall be entitled solely and exclu-
sively to the emoluments arising from the wharfage
thereof, including the wharfage of the said wharfes thus
to be continued twenty two feet and a half wide in front
of William and Johnson streets as aforesaid, and shall
be subject to the rules and regulations prescribed by the
mayor and city council of the city of Baltimore respect-

ing the wharfage thereof. Provided always, AND BE
IT ENACTED, That the mayor and city council of
Baltimore shall be, and hereby are authorised and em-
powered to fill up and wharf out at the expense of the
said city the aforesaid spaces of twenty-two and an half
feet in front of the said streets called William street and
Johnson street on the west sides thereof; and in that case
shall be entitled to the wharfage thereon as public
wharves, on condition that the said mayor and city coun-
cil shall elect to do so at their next annual session alter
the passing of this act, and shall commence the said
Work before the month of June following, and shall
complete the same so far as relates to William street on
or before the first day of January in the year eighteen
hundred and fifteen, and so far as relates to Johnson
street in the course of that year, and not otherwise; in
default whereof the said Christopher Hughes or other
persons entitled as aforesaid, shall have the privileges
and powers relative to the said spaces, which are herein
before provided,

CHAPTER 72.

Proviso.

An act to authorise the levy court of Baltimore county,
to assess and levy a sum of money for the purposes
therein mentioned.
Section 1. BE IT ENACTED by the General As-
sembly of Maryland, That the levy court of Baltimore
county be, and they are hereby authorised and empow-
ered at their annual session, to assess and levy on the
assessable property of said county, in their discretion
a sum not exceeding twelve hundred dollars, for the pur-
pose of repairing the public roads and streets in the
