pleted; Provided, the managers of the said lottery shall give their
assent to this bill, and relinquish their right to draw any lottery or
lotteries under the authority heretofore granted, which assent and
relinquishment shall be filed with the treasurer of the western
shore, on or before the first day of May next; And provided also,

that if the system of state lotteries should be abandoned, and any
private lottery or lotteries hereafter granted, before the completion
of the said monument, then, and in that case, the managers of the
Washington monument lottery, are hereby authorised and em-
powered to propose a scheme or schemes and proceed to draw
any lottery or lotteries for the purpose originally contemplated by
the act or acts relating to the erection or completion of said mo-
nument.

port.

2. And be it enacted, That in case the managers of the Wash-
ington monument lottery, shall assent and relinquish as herein be-
fore provided, it shall be their duty to report annually on or before
the first day of January to the treasurer of the western shore, an
account of their proceedings, together with a statement of the
amount and objects of their expenditures, and it shall be the duty
of the treasurer to lay such account before the legislature at every
session thereafter.

CHAPTER 126.

An act relating to the Governor and Council of this State.
Whereas, by an act entitled, An act to alter the time of the mee-
ting of the General Assembly of this state and for other pur-
poses, passed at December session, eighteen hundred and twenty
three, chapter one hundred and eleven, and confirmed at the pre-
sent session, it is provided that the governor and council shall be
elected in the month of January, instead of the month of Decem-
ber, as heretofore; And whereas, doubts are entertained whether
a suspension of executive power will not thereby occur; for reme-
dy whereof,

Be ii enacted by the General Assembly of Maryland, That the go-
vernor and council for the present year be, and they are hereby
authorised and empowered to act in their executive capacity, until
the times severally prescribed for the next election of a governor
and council by the above recited act.

CHAPTER 127.
An act to authorize the Orphans Court of Calvert county, to cause the real
estate of the late William Reynolds of Culvert county to be sold.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
it shall be lawful for the Orphans court of Calvert county to
appoint four persons of judgment and discretion, and not of kin to
any of the parties concerned, and to issue a warrant commanding
them to appraise at a fair price, the lands belonging to Mary Rey-
nolds; and also the lands of the heirs of William Reynolds, which
appraisement shall be returned to the said Orphans court.

2. And be it enacted, That it the said Mary Reynolds shall file
with the Register of wills of said county, her consent in writing
to the sale of her said land, together with the lands of the heirs
of the said William Reynolds, deceased, then it shall and may be
