ability unless he produces to the commanding officer of the regiment
within whose district he shall reside, a certificate of the surgeon of
such regiment if any, and if not of some practising physician of the
city of Baltimore, stating that he has carefully examined such person,
and that he is in the opinion of said surgeon or physician incapable
of performing Militia duty by reason of some bodily infirmity; and
the commanding officer of the regiment as aforesaid, shall forthwith
in writing said person for such a period of time as in his opinion the
certificate of said surgeon or physician will justify.

16. And be it enacted, That each commanding officer of the third
and fourteenth, brigades is hereby required to order a meeting of the
Colonels, Lieutenant Colonels and Majors of the district regiments
within his brigade, previous to the first of March next, at some con-
venient place, who or a majority of them shall revise and fix the
bounds of his regimental districts; and each commanding officer as

aforesaid shall as soon thereafter as may be, make a return in writing
of such arrangement of bounds to the commanding officer of the
division to be by him recorded; and the commanding officer of each
regimental district within said brigades is hereby required to order
a meeting of the regimental field and company officers within his

district, previous to the fifth of March next, at some convenient place,
who, or a majority of them, shall revise and fix the bounds of the se-
veral company districts as herein before directed, and the company
districts of each regiment laid off as Artillery company districts as
directed by this act shall be forthwith communicated in writing by the
commanding officer of said regiment to the commanding officer of the
second regiment of Artillery, for the purpose of organizing said
regiment according to law; and the commanding officer of said re-
giment shall also forthwith make returns thereof in writing to the
commanding officer of his brigade to be by him recorded; and the
said several districts in each brigade and regiment as aforesaid shall
be altered or arranged in like manner by said officers under the same
penalties whenever they or a majority of them shall deem it neces-
sary, for the greater convenience of those liable to Militia duty, and
returns made thereof as in this section heretofore directed; Provi-
ded, that the field and company officers of said second regiment of
Artillery, shall assist at any future arrangement of bounds after the
first as herein directed; and if the commanding officer of said second
regiment of Artillery shall consider himself aggrieved by the divi-
sion and allotment of the company districts as hereinbefore provi-
ded and shall make complaint thereof to the commanding officer of
the division, it shall be the duty of the said commanding officer of
the division to institute a board of field officers, consisting of five
taken indiscriminately from the several regiments of the division,
which board shall have full power to adjust the subjects of complaint
in a manner most conformable in their opinion to the design of this
act, the decision of which board shall be final between the parties;
and if any officer shall neglect or refuse to comply with any of the
provisions of this section, as required of him he shall be fined a sum

not exceeding one hundred dollars, in the discretion of such court
martial as the case may require.

Penalty.

17. And be it enacted, That at all the meetings directed by this
act, the commanding officer of each company shall appoint a fit and
proper person who shall call over the muster roll of said company
noting those who are absent, and within two days thereafter shall
make return in writing of such absentees to the commanding officer
