lay out a road in Montgomery and Anne-Arundel Counties, passed
at this present session of Assembly, as authorises the opening of a
road within five miles of the Baltimore and Frederick-Town Turn-
pike Road, be, and the same is hereby repealed.

2. And be it enacted, That the commissioners, or a majority of
them appointed by the act before mentioned for Anne-Arundel
County as soon as convenient, shall proceed to open, and cause to
be repaired, the road commonly called the Columbia Turnpike Road,
and repair the bridge over Patuxent River, near Charles S. Ridgley's
mill, commencing at the end of five miles from the Baltimore and
Frederick Turnpike Road, and ending at the Patuxent River, at or
near Crow's mill.

3. And be it enacted, That the commissioners aforesaid, or a ma-
jority of them for Anne Arundel County, be, and they are hereby au-
thorised and empowered to employ an overseer; and such necessary
carpenters, laborers, and wagons and carts, and to purchase such ma-
terials as may be wanted to carry into effect the aforegoing section.

4. And be it enacted, That the overseer, labourers, wagons and
carts so as aforesaid to be employed, shall be entitled to receive the
same pay as is now allowed by law to supervisors, laborers, wagons
and carts, for similar work done on the public roads in Anne-Arundel
County, and a certificate certifying the amount due to any person or
persons for materials, labor, or the use of his, her, or their wagon
or cart signed by a majority of said last mentioned commissioners,
shall be received by the levy court or collector as evidence of his,
her or their claim against Anne-Arundel County.

Compensa-
tion.

5. And be it enacted, That the said last mentioned commissioners,
or a majority of them, shall as soon as the said road shall be opened
and repaired, from the end of five miles from the Baltimore and Fre-
derick Turnpike Road, to the Patuxent River aforesaid, make out an
account in writing of the whole amount of the expenses of opening
and repairing the last mentioned part of said road and the bridge
aforesaid, and return the same to the clerk of Anne-Arundel County
Court, whose duty it shall be to record the same among the records of
said county.

Accounts.

6. And be it enacted, That the said road and bridge when so
laid out opened and repaired, shall be kept and repaired as other
public roads and bridges in said county are kept and repaired.

Future re-
pairs.
|
7. And be it enacted, That the company or their successors, incor-
porated by a law passed in eighteen hundred and nine, to make a
Turnpike Road from the District of Columbia to intersect at Elli-
cott's mills, the Turnpike Road leading from Baltimore to Frede-
rick-Town, shall have the right to take, use and occupy the road, or
any part thereof so as aforesaid to be opened and repaired, commen-
cing at Barnes' Tavern, on the road leading from Rockville, in Mont-
gomery County, to Bladensburg, and ending at the distance of five
miles from the Baltimore and Frederick-Town Turnpike Road, when-
ever the said company or their successors shall pay to the respective
counties of Anne-Arundel and Montgomery, the amount so to be
laid out and expended by them respectively by virtue of this act,
or the act passed at this present session of assembly before men-
tioned.

8. And be it enacted, That the levy court of Anne-Arundel Coun-
ty be and they are hereby authorised and required to levy on the
assessable property of said county such a sum of money as may be
sufficient to carry into effect the provisions of this act.
