upon the said application, are hereby required to issue their warrant,
under their hands and seals, directed to the sheriff of Baltimore
county, commanding him to summon twelve disinterested men,
qualified by law to serve as jurors in the county court, to meet upon
the premises at a certain day, of which ten days notice, at least, shall
be given to the party or parties interested, and the said jurors, when
so met, and having each taken an oath before some justice of the
peace, that he will, without favor, affection, prejudice, or partiality,
assess the damages to be sustained by the person through whose land
the said road is about to pass, by reason of altering, changing and
opening the same, through his or their land, shall thereupon proceed
to value and assess the damages accordingly, taking into considera-
tion the advantages and disadvantages, if any; and such inquisition
and valuation shall be final and conclusive between the parties re-
spectively, and shall be returned by the jurors aforesaid to the jus-
tices by whom the aforesaid warrant was issued: and the damages so
assessed shall be paid, or tendered by the said president, managers
and company, to the person or persons in whose favor the same shall
be assessed, before they shall proceed to open the said road through

the said land.
3. And be it enacted, That the president, managers and company of
the Falls turnpike road, are hereby authorised and empowered, after
payment or tender of the damages aforesaid (should there be any as-
sessed) to open and make the alteration and change in said road, and
for that purpose to enter upon, pass through, use and occupy, all the
lands included within the location of the said road, of the width as
contained in the original act, any law to the contrary notwithstand-

4. And be it enacted, That the said commissioners, for and in con-
sideration of their services in the execution of this act, shall receive
the sum of two dollars per day, for every day that they, or a majority
of them, shall meet about said business, and that the same shall be
paid by the president, managers and company of the Falls turnpike
road.

Compensa-
tion.

5. And be it enacted, That before this act shall go into operation,
the same shall be laid before a general meeting of the stockholders of
the said Falls turnpike company, convened for that purpose, upon
such notice as the original act requires in cases where the said presi-
dent, managers and company of said turnpike road may call a general
meeting, and, by a majority of said stockholders, be assented to and
accepted, and such assent recorded among the other proceedings of said
company; and unless this assent be given within one year from the
passage of this act, this act shall be null and void.

Proviso.

CHAPTER 156.

An act to fix on the place for holding the election in the second election
district, in Anne Arundel county.
Be it enacted by the General Assembly of Maryland, That all elec-
tions to be hereafter held in the second election district, in Anne
Arundel county, shall be held at the black horse tavern, in the said
election district, any law to the contrary notwithstanding.
