Application
of money.
|
6. And be it enacted, That the commissioners shall apply the
money arising from such sale or sales as soon as it shall be received,
first for defraying the expenses of the commission, and then to the
discharge of the debts due, as aforesaid, from the said Anthony Ad-
dison and Henry A. Callis, distributing the proceeds, as they arise,
amongst the creditors in proportion to the amount of their respec-
tive claims.

Vacancy.
|
7 And be it enacted. That in the case of the death, resignation,
or refusal to act of one or more of the commissioners appointed by
this act, the remaining commissioner or commissioners shall have
power to appoint a commissioner or commissioners to supply such
vacancy: Provided always, that this act shall not be so construed as
to disturb the rights of any persons claiming title to any part of said
land under the said Anthony Addison and Henry A. Callis.

CHAPTER. 66.
An act relating to the Stone Quarries on the Falls Turnpike Road, near
Baltimore.
Whereas a dangerous and alarming practice has prevailed at the
stone quarries on the Falls road, near Baltimore, of making explo-
sions without regard to the safety of travellers, therefore,
Section 1. Be it enacted by the General Assembly of Maryland,
That from and after the first day of May next, the proprietors of all
the quarries on either side of the Falls Turnpike Road, between the
second mile stone on said road and the city of Baltimore, be, and
they are hereby required to cause notice to be given, by means of a
bell of such size and sound as may be heard at the distance of six
hundred yards, of each and every explosion or blast, at least five
minutes before any such explosion or blast shall be made.

Penalty.
|
2. And be it enacted, That for each and every violation or neglect
of the provision of this act, the proprietor (or tenant, in case of
lease) of the quarry wherein such neglect or violation shall occur,
be, and he is hereby subject to a fine of ten dollars, to be recovered
by warrant before any justice of the peace of Baltimore county or
city; the whole to go to the informer

CHAPTER 67.
An act authorising the establishment of a ferry over the Potomac river,
from the lands of George Lafevre, in Washington county, opposite
the place called the Falling Water, in Virginia.
Whereas it is represented to this General Assembly, that the
establishment of a ferry from the lands of George Lafevre, in
Washington county, opposite to the place called the Falling Water,
in Virginia, would be of great public benefit, therefore,

Sec. 1. Be it enacted by the General Assembly of Maryland, That the
Court of Washington county be, and they are hereby authorised and
empowered to grant a license to Geo. Lafevre, of Washington coun-
ty, to keep a ferry from his lands, in said county, over the Potomac
river, to the opposite shore, near or opposite to the place called the
Falling Water; and such license to renew from time to time, and to
fix such rate of ferriage as they in their discretion may think proper.

Public ferry.
|
2. And be it enacted, That the said ferry, when, licensed by the
county court aforesaid, shall be forever thereafter deemed and taken
to be a public ferry, and subject to the same regulations as public
ferries now are by the existing laws of this state.
