teen hundred and twenty four, the remaining half with the interest and any ad-
ditional costs that may accrue, on or before the first day of October, eighteen
hundred and twenty five, the one half of the second judgment with all the in-
terest and costs, on or before the first day of October, eighteen hundred and
twenty six, and the remaining half with interest and any additional costs that
may accrue on or before the first day of October, eighteen hundred and twenty
seven; Provided, that nothing herein contained shall be construed to release the
right of the state to any property, real or personal, which has been already taken
in execution as the property of the said Thomas Harwood, of Benj. and if the
first payment is not punctually made at or before the time specified, this resolu-
tion shall then be considered null and void.

Resolved, That the treasurer of the western shore be, and he is hereby au-
thorised to credit the bond executed by Thompson Randolph, with Thomas Rut-
ter, his security, to the state of Maryland, with the composition money paid by
Lewis Miller for the same land for which the said bond was given, on a state-
ment of the sum paid, with a certificate of the treasurer of the eastern shore
annexed, being filed in the treasury office.
No. 31.
Resolved, That the treasurer of the western shore, pay to John Quynn, door-
keeper to the house of delegates, the sum of sixty dollars, to Andrew Slicer,
messenger to the senate, the sum of sixty dollars, for taking care of the furni-
ture of their respective rooms, during the recess of the legislature.

No. 32.
The committee to whom was referred the petition of William Gist, of
Dorchester county, have considered the same, and make the following report—
The petitioner states that he is now a debtor to the state of Maryland, on judg-
ment for the purchase money of certain Choptank Indian lands, in Dorchester
county, and that he has recently sold the said land upon a credit, and is now
unable to pay and satisfy the said judgment, but will be able to do so when
the credit expires which he has given the purchaser. And -whereas, several
other purchasers of the adjoining lands are in a similar situation, and it is rea-
sonable that some indulgence should be extended to the said petitioner anil
others in the same situation. Be it therefore

Resolved, That all proceedings on the said judgments shall be suspended un-
til the first day of December, eighteen hundred and twenty five, Provided,
That each of the said defendants shall pay to the treasurer or agent of the
eastern shore the one third part of the said judgments in the manner follow-
ing, that is to say, the one third part of the principal and all the interest and
costs due thereon, on or before the first day of December, eighteen hundred
and twenty three, the like sum of principal and all the interest due on the re-
mainder of the principal on the first day of December, eighteen hundred and
twenty four, and the remaining part of said principal with all interest and
cost due thereon, on the first day of December, eighteen hundred and twenty
five, and if either of the parties shall neglect to pay the proportion or install-
ments so as aforesaid directed to be paid by him, then execution shall and may
forthwith be issued on the judgment or judgments against the party or parties
so neglecting to pay as aforesaid, in the same manner as if this resolution had
not passed, Provided also, that nothing in this resolution contained shall pre-
vent the state from recovering any part of the said debt from any of the said
parties, if either of the defendants shall become unable or neglect to pay the
part or installment so as aforesaid ordered to be paid by them respectively.

No. 33.
WHEREAS, It is a matter of "most interesting importance to the people of this
state, that a water communication should be opened between the city of Haiti-
more and the Potomac river, in such manner as to constitute a branch to the
projected canal between Cumberland and George-Town; and that such com-
munication should be made at the most convenient point, above or below the
river Monocacy; Therefore,
Resolved, That the governor and council be directed to issue a commission
to three persons of skill and integrity, to survey, locate and lay out the route of
a canal from the city of Baltimore to the Potomac river, at the mouth of the Mo-
nocacy; or at any other point adjacent thereto, not going further up the river
than Harper's Ferry; selecting such route as shall in their judgment be most
practicable and the least expensive in the construction of a canal.
Further Resolved, That the governor and council be authorised and directed
to employ the most skilful engineer they can obtain, to accompany the said
commissioners in the performance of the duties required by these resolutions.
Further Resolved, That the commissioners and engineer appointed in virtue
of these resolutions, report to the executive as scon as they shall have complet-
ed their work, all the particulars of their survey and location, with proper plats
of the same, and as full and accurate estimate as they may be enabled to make
