original and real title, shall, within one year from the date of the
publication, pay or tender to be paid to the purchaser or purchasers,
his or their assigns, the amount of the original purchase money, and
all taxes paid thereon, with ten per cent, per annum, and where im-
provements have been made thereon, the amount of the costs of such
improvements, with ten per cent, per annum; the value of such im-
provements, where the parties cannot agree, to be ascertained by two
persons chosen by said parties, each to name one man nowise related
to him, which said two persons may choose an umpire, in case of any
difference of opinion, the award of whom shall be binding upon both
parties and effectual in law; and such purchaser or purchasers, so ad-
vertising as aforesaid, shall lodge with the clerk of Allegany county
court, either the different newspapers in which he has published the same,
or the affidavit of each of the different printers, whose duty it shall
be to record the same, which record shall be good and sufficient evi-
dence that the provisions of this law have been complied with.

2. And be it enacted, That from and after the passage of this act,
it shall be the duty of the collector of the county of Allegany, to
comply with the requisition of the commissioners of the tax by pub-
lishing non-resident land in the different newspapers, as by them di-
rected, and it shall be his duty to produce to the clerk of Allegany
county court, either the different newspapers in which he was direct-
ed to publish the same, or the affidavit of each of the different prin-
ters previous to the day of sale, and it shall be the duty of the clerk
to make a record of the same, which record shall be sufficient evi-
dence in all future cases to give title to the purchaser or purchasers,
and the title so acquired from the collector shall be as good and avail-
able in law, as if the sale had been made by its original and real
owners, any law to the contrary notwithstanding.

3. And be it enacted. That if the collector shall omit or neglect
to make a return to the clerk of Allegany county court of the differ-
ent newspapers, or the affidavits of the different printers as required
by this law for every such omission or neglect, he shall forfeit and
pay the sum of one hundred dollars current money to be sued for
and recovered by action of debt, in the name of the commissioners
of the tax and to be applied to the use of said county in such man-
ner as the justices of the levy court or a majority of them shall di-
rect.

4. And be it enacted, That where any part or whole tract or tracts,
lot or lots of land shall be sold by order of the commissioners of the
tax of said county, under the provisions of this act, upon the owner
or owners, his, her or their legal representatives paying or tendering
payment to the purchaser or purchasers, his, her or their heirs or as-
signs the purchase money with an interest of twenty five per cent per
annum, thereon and all other legal charges, within one year from the
time of such purchase, that then the purchaser or purchasers thereof,
his, her or their heirs or assigns, shall reconvey to the original own-
er the tract or tracts, lot or lots of land so sold and purchased as a-
foresaid.

5. And be it enacted, That the further additional supplement to
an act, entitled, An act for the more effectual collection of the coun-
ty charges in Allegany county, passed December session, eighteen
hundred and eighteen, chapter one hundred and eighty five, be and
the same is hereby repealed.

Repeal.

6. And be it enacted, That so much of the act to which this is a
supplement as is consistent herewith shall be and is hereby repealed.
