SAMUEL STEVENS, Jr. ESQUIRE, GOVERNOR

Dec. Ses. 1822

John M'Elderry guardian of Jane M'Elderry, and Hugh M'Elder-
ry, guardian of Edward, Henry and Ann M'Elderry, be, and they
are hereby respectively authorised and empowered to borrow for a
term not less than ten years, such sum or sums of money sis may be
necessary for wharfing out the lots of ground of their respective
wards, situated on Union Dock in the city of Baltimore, and to mort-
gage said lots to any person or persons or bodies corporate that may
be disposed to lend such monies, for securing the repayment thereof,
at or before the expiration of ten years from the date of such mort-

gage or mortgages, and the interest thereof in the mean time annu-
ally; Provided, the sums of money thus to be borrowed shall not ex-
ceed fifteen dollars for each front foot of the ground of said minors,
on said clock.

2. And be it enacted, That any mortgage or mortgages which may
be executed by the said John M'Elderry and Hugh M'Elderry pur-
suant to the provisions of this act shall be as available in law, as if
the said Jane, Edward, Henry and Ann M'Elderry were respectively
of the age of twenty one years and executed the same; Provided

however, that no mortgage shall be given under this act unless on a
petition by the said John M'Elderry and Hugh M'Elderry, to the
orphans court of Baltimore county, the said court shall be of opinion
that it will be for the interests of the minors concerned, that such
mortgage should be given.

CHAPTER 167.

An act to incorporate the trustees for the poor of Baltimore city and
county.
Section 1. Be it enacted by the General Assembly of Maryland, That
there shall be annually appointed seven trustees for the poor of Bal-
timore city and county, four of whom shall be residents in the city
of Baltimore and shall be appointed by the mayor and city council of
Baltimore in the same manner as officers under the corporation arc
appointed; and the other three shall be residents in Baltimore coun-
ty, out of the said city, and shall be appointed by the governor and
council, and all vacancies that shall occur shall be filled by appoint-
ments to be made in the same manner; and the said seven trustees
and they successors to be appointed as aforesaid, shall be and they
are hereby incorporated and constituted: i body politic and corporate,
by the name, style and title of The Trustees for the Poor of Balti-
more city and county, and by that name shall have perpetual succes-
sion, and shall be capable in law to sue and be sued, to plead and be
impleaded, in any court of law or equity, or before any judge or jus-
tice, to purchase, take, receive, possess, hold, use or sell, convey and
deliver all kind, of lands, tenements, estates, property and effects,
real, personal and mixed, to have and use a common heal, and the
same at their pleasure to break, alter or renew, and to exercise all the
powers, authorities and privileges granted to or vested in them by
this act, or which shall be vested in them by any future act of assem-
bly, as fully to all interest and purposes as any other corporate body

act, before he proceeds to perform any duties as such, shall, before
some judge or justice of the peace take and subscribe an oath or
