lands shall be valued and assessed as lots of four acres of ground
with the buildings and improvements thereon, and shall not be valu-
ed and assessed by the number of acres in said farms or part or
parts of farms.

Appeal.
|
8. And be it enacted, That if any of the owners of property
assessed within said town, shall conceive themselves aggrieved by
the assessment so as aforesaid made by said assessors, they may
appeal to the said president and commissioners, who shall have
power and authority to make such deduction from the valuation of
their property as to them shall seem reasonable and just.

Officers—
bonds.
|
9. And be it enacted, That the said president and commis-
sioners from time to time, and under such conditions as they may
by their ordinances direct, appoint such officers as they may deem
necessary to carry into effect their ordinances, among whom shall
be a town bailiff who shall ex-officio be collector of the town tax,
and who shall have all the power and authority of a constable with-
in said town, and within the hundred wherein said town is situated;
and said town baliff shall give bond to be approved of by the justi-
ces of the levy court of Cecil county, as other constables now do,
for the faithful performance of his duty as constable; and also bond
to said president and commissioners for the faithful performance of
his duty as town bailiff and collector of the tax as aforesaid, and for
the faithful performance of such duties as shall be imposed on him
by the ordinances of said president and commissioners.

Powers of pre-
sident.
|
10. And be it enacted, That the president of the commission-
ers shall, in virtue of his office, have and exercise within the limits
of said town, all the jurisdiction and power of a justice of the peace,
except as to the recovery of small debts; he shall have power to call
upon any officer of the town entrusted with the receipt and expen-
diture of public money for a statement of their accounts as often as
he shall sec proper; he shall sec that the ordinances are duly and
faithfully executed, and report to the commissioners at their stated
meetings the general state of the town, and also call special meet-
ings of the commissioners whenever he shall see fit.

Oath.

11. And be it enacted, That the president of said commis-
sioners and all other officers of said town, before they enter upon
the execution of their respective offices, shall severally take the fol-
lowing oath or affirmation. "I do solemnly swear (or affirm, as the
case may be,) that I will faithfully execute the office of
to the best of my knowledge and ability, without favor, affection or
partiality."

Failure to e-
lect.
|
12. And be it enacted, That should the inhabitants at any
time neglect to make an election in the manner and at the times re-
quired by this act, the power of electing commissioners shall not
thereupon cease, but the right and powers of said inhabitants of said
town, in that respect, shall continue the same as though such elec-
tion had been made; and the president and commissioners for the
time being shall continue and remain in office, with like power and
authority until such annual election shall be held as aforesaid.

Repeal.
|
13. And be it enacted, That all the acts of assembly hereto-
fore passed in relation to the Town of Elkton, or to the commissi-
oners thereof, and the several parts thereof, inconsistent with the
provisions of this act, be, and the same are hereby repealed.
