at the head of the basin of Baltimore, hereinafter described, or on
such parts thereof as may to him appear to be necessary or proper,
a ware-house for receiving and containing tobacco offered for in-
spection, if in the judgment of the levy court of Baltimore county
the erecting such ware-house would promote the public interest and
convenience; and that said ware-house shall consist of one or more
buildings to be situated on two lots or such parts thereof as the
said Christopher Hughes shall deem convenient; which said lots
are contained within the following metes and bounds: beginning for
the first at the north west intersection of Quay-street, and a twenty
two and a half feet street, and running thence westwardly, bounding
on Quay-street one hundred feel; thence northwardly at right an-
gles to Quay-street, and parallel to William-street, one hundred
feet more or less to Quay-alley; thence eastwardly bounding on
Quay-alley one hundred feet, to the twenty-two and a half feet
street aforesaid; thence bounding on said street to the beginning;
and for the second part, beginning at the distance of fifty feet south-
wardly from the north side of Lee-street, on Hughes' Quay, and
ten feet eastwardly from William-street dock, and running thence
eastwardly parallel to Lee-street, along Hughes' Quay one hundred
and forty-feet; thence southwardly parallel to William-street dock
eighty feet to Quay-alley; thence westwardly bounding on Quay-
alley one hundred and forty feet; thence to the beginning. And said
ware-house, when so built, and the ground on which the same may
be erected, shall be received and used as a place for the public in-
spection of tobacco, in the said city, subject to the provisions here-
inafter contained.

2. And be it enacted, That the said Christopher Hughes, or
those claiming to hold under him, shall provide and keep constant-
ly in repair, at his or their expense, beams, screws, scales, weights,
brands and marking irons, and all other things necessary for in-
specting tobacco brought to said ware-house for inspection And the
said ware-house when erected and finished, shall be deemed a pub-
lic ware-house, and the proprietor or proprietors thereof, or those
claiming under him, her or them, may demand, and shall be enti-
tled to receive one dollar for each and every hogshead of tobacco
inspected at said ware-house, before such hogshead shall be remov-
ed, as a full compensation for the expense of erecting said ware-
house, and keeping the same in repair, and for providing proper
screws, scales, weights, brands and marking irons, and all other
things necessary for inspecting tobacco, and for the payment of the
salary or salaries to the inspector or inspectors, as the proprietor or
proprietors of the said ware-house shall agree to pay. And if any
tobacco shall remain in said ware-house above one year after in-
spection, the proprietor or proprietors may demand, and shall be en-
titled to receive, for each and every hogshead of tobacco so remain-
ing, the further sum of twelve and a half cents for every month
thereafter.

3. And be it enacted, That the justices of the levy court of
Baltimore county, or a majority of them, shall, when the said ware-
house shall be erected and finished, and ready for the reception and
inspection of tobacco, nominate and recommend in writing to the
governor and council, two persons, or if requested by the proprietor
or proprietors of the said ware-house, four persons, of whom the go-
