1820.

4. And be it enacted, That the said medical society of Balti-
more be and they are hereby empowered, to make from time to
time as they may judge expedient, such by-laws. or other rules
for the regulation and government of the members of said cor-
poration, and the same to change, add to, or amend, as may ap-
pear necessary or proper, to fix the times and places for their ge-
neral meetings, the modes and times for electing officers, and for

filling up vacancies; Provided always, that such by-laws or rules
be not contrary to the constitution and laws of the United States
or of the state of Maryland.

Proviso.

CHAP. CXLVI.
An Act for the benefit of Joseph Jamison and Frederick Johnston, of Baltimore
County.

WHEREAS the said Joseph Jamison and Frederick Johnston,
have by their petition represented to this general assembly, that
Robert Bigham now deceased, did in his life-time execute two
several mortgages to the petitioners; that the said Robert Big-
ham is dead without complying with the terms of the conditions
of the said mortgages; that an interest in law of the mortgaged
property hath descended to the legal representatives of the said
Hubert Bigham, (he having died intestate, leaving no lawful
heirs of his body, but a number of collateral ones;) that to get
specific foreclosures and performances of the said mortgagers, it
is necessary to file bills in some court of equity against the legal
representatives of the said Robert Bigham; that the said legal
representatives reside in various parts of the United States, and
some of them in Ireland, but being unknown to the petitioners,
and are so numerous and scattered, that they cannot ascertain
their names or places of residence, and are without remedy, ac-
cording to the existing laws of this state; Therefore,

Passed Feb. 12, 1821.

Preamble.

1. Be it enacted by the General Assembly of Maryland, That the
Baltimore county court, as a court of chancery, upon hills being
filed by the said Joseph Jamison and Frederick Johnston, against
the legal representatives of the said Robert Bigham, without
naming all of them, to obtain foreclosures of the said mortgages,
the said court instead of issuing subpoenas for the legal represen-
tatives of the said Robert Bigham, to make them defendants,
shall and they are hereby authorised to cause the object and sub-
stance of the said bills to bo published once a week for six suc-
cessive weeks in two newspapers in the city of Baltimore, to
warn the legal representatives of the said Robert Bigham, with-
out naming all of them, upon a day therein limited, to appear in
the said court in person, or by solicitor, to shew cause, if any
they have, why decree should not pass as prayed.

2. And be it enacted, That if the legal representatives of the
said Robert Bigham, so made defendants, shall not appear to
answer the bills of the said Joseph Jamison and Frederick John-
ston, and those under whom they claim, after being warned as
aforesaid, the said Baltimore, county court, as a court of chance-
ry, may without the appearance of the absent parties, at discre-
tion, either take the bill of the said Joseph Jamison and Freder-
ick Johnston, pro confesso, or issue a commission for taking depo-
sitions, which commission may be executed ex parte, on the non
