1820.

CHAP. CXXVI.

An Act relative to the making of a public Landing Place and Road in Somerset
County.

1. Be it enacted by the General Assembly of Maryland, That
George Jones, (of Robt.) Jesse Hughes, and Littleton Aires, be
and they or a majority of them, are hereby appointed commis-
sioners, to meet at the place commonly called Harris's Landing,
on Wicomico river, in Somerset county, during the present year,
and examine and determine whether the public convenience does
require that a public landing should be established at or near
said landing, and a public road located and opened to said laud-
ing, and if in the opinion of the said commissioners, or a majori-
ty of them, the public convenience does require that a public
landing should bo established, and a road located and opened to
said landing, they or a majority of them, shall lay out a quanti-
ty of land for a public landing place on Wicomico river, at or
near the aforementioned place, not exceeding two acres, and shall
locate and open a road leading down to said landing, in such
manner as they or a majority of them may think most conducive
to the public benefit, and the said commissioners, or a majority of
them, are hereby required to return a plot of said landing place
and road to the clerk of Somerset county, there to be recorded,
together with an estimate of the damages sustained by any per-
son or persons whose land may betaken, laid out, and appropriat-
ed as aforesaid.

2. And be it enacted. That if the said commissioners, or a ma-
jority of them, shall be of opinion that the public convenience
does require that a Ianding should be established at or near the
aforementioned place, and a road located and opened as afore-
said, they shall report the same in writing to the levy court of
Somerset county, and if the levy court, or a majority of them,
shall approve of such opinion, the said court is hereby empower-
ed and directed to assess and levy the amount of such damages as
shall be ascertained by the commissioners aforesaid, which sum of
money shall be levied, collected and paid over, as other county
charges are levied, collected and paid over.

3. And be it enacted, That if the commissioners aforesaid, or a
majority of them, shall lie of opinion that the public convenience
dues not require that a landing place should he established at the
aforementioned place, and a road located and opened, they shall
report such opinion in writing to the levy court aforesaid; and
each of the commissioners hereby appointed, shall have an allow-
ance of two dollars for each and every days attendance in dis-
charge of the duties herein required, to he levied, collected and
paid over, as other county charges are levied, collected and paid
over.

4. And be it enacted, That if any person through whose land
said road may pass, or whose land may be condemned for the
landing aforesaid, shall conceive themselves aggrieved, either by
the assessment of damages or by the location and condemnation
as aforesaid, it shall and may be lawful for such person or per-
sons to pray an appeal from the decision of said commissioners,
or the said levy court, to the judges of Somerset county court,
who are hereby authorised and empowered to empannel a jury,
