cessary for the use and consumption of his family and cattle, un-
der the penalty of one dollar for every cord of fire-wood, and fif-
ty cents for every hundred weight of hay, so purchased, dealt or
bartered for, contrary to this art.

CHAP. 159.
|
|
|
25. And be it enacted, That if any person appointed to weigh
hay and cord fire-wood as aforesaid, shall refuse or delay to weigh
the hay or cord the fire-wood which he shall be required to weigh
or cord, either by the purchaser or seller, pursuant to the direc-
tions of this act. such person shall forfeit and pay the sum of one
dollar for every refusal or delay.

26. And be it enacted, That if any person, having brought fire-
wood or hay to the said town for sale, and having sold the same,
shall afterwards refuse to suffer such fire-wood to be corded, pack-
ed and measured, or such hay to be unpacked and weighed, by
the person to be appointed as aforesaid for these purchasers, (the
same having been required by the purchaser to be done ,) such
person shall forfeit and pay the sum of two dollars for every re-
fusal.

27. And be it enacted, That it shall not be lawful for any per-
son or persons to keep or raise any geese or swine within the li-
mits of the said town, except in pens or other enclosures, and if
any geese or swine shall be found going at large within the said
town, it shall be lawful for the bailiff of the said town, upon the
information of any of the inhabitants thereof, or upon his own
view, to seize all such geese and swine, and to secure the same in
some common pound, to he provided by the said commissioners
for that purpose, and all and every such geese and swine, so seiz-
ed and secured, shall be forfeited for the benefit of the said town,
and shall be sold at public auction to the highest bidder, and the
profits arising from the sale thereof, (except the sum of ten cents
for every goose, and the sum of twenty-five cents for every swine,
to be retained by the said bailiff for his trouble,) shall be account-
ed for and rendered by the bailiff to the said commissioners, to
be applied by them for the use and advantage of the said town;

Provided nevertheless, that the owner or owners of the said geese
and swine, or some person for them, may within one day after
the impounding thereof, redeem the same, by paying to the bailiff
the sum of twenty-five cents for every such goose, and the sum
of one dollar for every such swine so seized and seemed, and the
said bailiff to be entitled to the same pay for taking up and im-
pounding the said geese and swine as is allowed him in case of
their being forfeited and sold, and to account for the balance to
the said commissioners; and moreover, every person who shall keep
or raise any geese or swine except in pens or other enclosures, or
shall willingly suffer any such geese or swine to go at large with-
in the said town, shall forfeit and pay the sum of fifty cents for
every goose, and the sum of two dollars for every swine, so kept
or raised or going at large contrary to the provisions of this act.

28. And be it enacted, That whenever it shall be judged neces-
sary by the said commissioners to assess and levy any sum or
sums of money on the inhabitants and owners of property in the
said town, for any of the purposes and subject to the provisions
herein before mentioned, the said commissioners shall make out a
fair and alphabetical list of every person chargeable, with such
