scribed by this act; Provided, persons carrying
on the shad and herring fisheries in this State,
may sell and dispose of so much salt as may be
necessary to cure the fish purchased of them, dur-
ing the months of March, April and May, and no
longer, without license; And provided also, that
nothing herein contained shall be construed to ex-
tend to vendors of cakes, or to the vendors of beer
or cider, who are the makers of such beer or cider ;
Provided nevertheless, nothing here contained shall
be construed to exempt the establishment of lager
beer, or the vendors thereof.

Provisos.

SEC. 2. And be it enacted, That when any per-
son or persons, body or bodies corporate, shall de-
sire or propose to sell or barter any of the arti-
cles, goods, wares or merchandise, enumerated or
mentioned in the first section of this act, except
spirituous or fermented liquors, it shall be the
duty of such person or persons, body or bodies
corporate, to apply to the clerk of the Circuit
court of the county in which the applicant may
reside, or if the applicant reside in the city of
Baltimore, then to the clerk of the court of Com-
mon Pleas of Baltimore, for a license therefor,
and upon such application, the said applicant
shall state to said clerk, on oath or affirmation, to
be by said clerk administered, or if the said appli-
cant shall reside in any county of the State, by
the said clerk or a justice of the peace adminis-
tered, the amount of said applicant's stock of
goods, wares and merchandise, generally kept on
hand by him, or the concern in which he is en-
gaged, at the principal season of sale, or if said
applicant shall not have been previously engaged
in such trade or business, the amount of such
stock he expects to keep as aforesaid; and if it-
shall appear from such statement so made under
oath as aforesaid, that the amount of the appli-
cant's stock in trade, does not or will not exceed
one thousand dollars, then the sum of twelve dol-
lars shall be demanded and received by said clerk
from said applicant, before granting the license
applied for; if more than one thousand dollars,
and not more than fifteen hundred dollars, then
the sum of fifteen dollars; if more than fifteen
hundred dollars, and not more than twenty-five
hundred dollars, then the sum of eighteen dollars ;
