LAWS OP MARYLAND.

CHAPTER 406.

Passed March
3, 1858.

AN ACT to waive in favor of the Western Mary-
land Railroad Company, any lien or claim which
the State may have on, or to the Green Spring
Branch of the Baltimore and Susquehanna or
Northern Central Railway Company.

Preamble.

WHEREAS, by the act of eighteen hundred and fif-
ty-two, chapter three hundred and four, section
fourteen, the Baltimore and Susquehanna Rail-
road Company was authorised to transfer to
the Baltimore, Carroll and Frederick Railroad
Company, any of its branches or lateral roads;
And whereas, by subsequent acts of Assembly,
the first named company has been consolidated
with other companies and is now known as the
Northern Central Railway Company, and the
name of the said last mentioned company has
been changed to that of the Western Maryland
Railroad Company; And whereas, as by the act
of eighteen hundred and fifty-four, chapter two
hundred and sixty, the State agreed to release
the mortgage then held upon the property, and
effects of the first said mentioned company, on
condition that the said Northern Central Rail-
way Company should execute to the State a new
mortgage according to the provisions of said
act, which said mortgage lias been since execu-
ted and accepted by the State; And whereas,
prior to the execution of said mortgage an
agreement was entered into by and between the
said two Railroad Companies for the transfer to
the said Western Maryland Railroad Company
of the lateral road or branch known as the Green
Spring Branch of the said Baltimore and Sus-
quehanna Railroad, but a conveyance thereof
was not made until after the execution of said
mortgage, to wit: until the first day of Octo-
ber, in the year eighteen hundred and fifty-sev-
en; And whereas, it is doubtful whether said
lateral road or branch may not be covered by,
and included in said mortgage; Therefore,

Lien waived.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That the State of Maryland
