LAWS OF MARYLAND.

no appeal bond is accepted by the justice of the
peace to arrest further proceedings on said judg-
ment or judgments, it shall be the duty of the officer
making the arrest and seizure, after having given
ten days notice by public advertisement, to sell
to the best advantage, for cash, for his benefit
and the benefit of those who assisted him in mak-
ing the arrest and seizure, the boat or craft in
his possession, together with all the furniture,
tackle and apparel, and all other property seized
and taken by virtue of this law.

Penalty for re-
sistence.

SEC. 6. And be it enacted, That if resistance be
made to the sheriff or any other officer engaged
in the execution of this law, such resistance shall
be deemed a misdemeanor against the laws of this
State, presentable by the grand jury of the county
and punishable in the Circuit Court by fine and
imprisonment as other misdemeanors arc punished.

Disposal of
funds arising
from seizure.

SEC. 7. And be it enacted, That after the pay-
ment of costs accruing from the prosecution of
offenders tinder this law, the balance arising from
the fine and sale of the boat and other property
hereinbefore mentioned, shall be divided or appor-
tioned in the following manner: one-half to the
officer and those who assisted him in making the
arrest and seizure, and the balance to be paid
over to the commissioners of, the county for the
benefit of the school fund of the county.

Provisions of
act extended to
Queen Anne's
county.

SEC. 8. And be it enacted, That that the pro-
visions of this act be and the same are hereby
extended to and made applicable to Queen Anne's
county.

Baltimore county.

Preamble.

WHEREAS, a certain Joseph E. Ford of Baltimore
county, and Kitty, his wife, did by their deed,
made on or about the thirty-first day of Janu-
