same, and at such election every free male citizen
who is entitled to vote for delegates to the Legis-

lature shall be entitled to vote for Trustees, Pro-
vided, he may have contributed to the support of
said Academy, or to improving the same, a sum
not less than ten dollars within the year next
preceding such election of Trustees; or provided
he may send any child or children, pupil or pu-
pils, to the said Academy at the time of said
election.

Proviso.

SEC. 3. And be it enacted, That the Trustees
elected under this Act as aforesaid, on the second
Monday in April next, and their successors
elected in the manner hereinbefore prescribed,
shall succeed to all the rights, privileges and
authorities of the Trustees of said Academy as
now incorporated by law, or to such of them as
may now be legal, and shall take, hold, succeed
to, and have the full ownership as Trustees of all
the property and rights now held by the Trustees
of said Academy and shall have full authority to
manage, direct and administer the affairs of said
Academy to the extent now allowed by law to
the present Trustees of said Academy.

SEC. 4. And be it enacted, That in case the
said Academy shall not be in actual operation at
the time of the first election of Trustees as here-
inbefore provided, all persons shall be entitled
to vote thereat who may have had any pupil or
pupils in attendance at the said Academy within
six months before said election.

Qualification

of voters.

SEC. 5. And be it enacted, That all acts and
parts of acts inconsistent with the provisions of
this act be and the same are hereby repealed.

Repealed.

SEC. 6. And be it enacted, That at the first elec-
tion of Trustees under this act four of the present
Trustees who may be selected by the present board
shall be elected into the new board of Trustees
hereby authorised to be elected, and if any of the
said four shall decline to serve, the said board
may fill said vacancy, but of the present board,
and the said board hereby authorised to be form-
ed shall have the power of filling all vacancies
that may occur in the same at any time here-
after.

First election.

SEC. 7. And be it enacted, That this act shall
take effect from the date of its passage.
