WHEREAS, it appears to the General Assembly of
Maryland, That, Horace Resley, Clerk of the
Circuit Court for Allegany county, paid into
the Treasury in the year eighteen hundred and
fifty-two, as a tax on his office, as provided by
the act of eighteen hundred and forty six, chap-
ter two hundred and fifty -three, the sum of two
hundred and ninety-nine dollars and fifteen
cents, and it appears to the said General As-
sembly, that by the fortieth section of the third
article, and the first section of the tenth arti-
cle of the Constitution, it was the intention of
the framers of that instrument to provide a new
mode, and abolish the old method of raising a
revenue from said offices, and that the said
Horace Resley has, under a misapprehension of
his duty, paid into the Treasury the said sum of
money, and it being right and just that it
should be refunded to him, Therefore,

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That the sum of two hundred
and ninety-nine dollars, and fifteen cents, be and
the same is hereby appropriated out of any un-
appropriated funds in the Treasury, for the use
of the said Horace Resley, and the Treasurer is
hereby authorised upon the warrant of the Comp-
troller to pay unto the said Horace Resley, the
said sum of two hundred and ninety-nine dollars
and fifteen cents.
