CHAPTER 319.
|
|
|
|
AN ACT to provide for the Public Execution of
Malefactors convicted and sentenced for capital
offences in Frederick County, within the limits
of the enclosed yard of the Jail of said County.
|

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That whenever a malefactor
has been convicted in the Circuit Court of Fre-
derick county, and sentenced to be hung for the
offence whereof he or she has been convicted, the
Sheriff of said county, shall at the proper time
as specified in the death warrant of the condemn-
ed, execute and hang the said convict in the en-
closed yard of the jail of the aforesaid county, in
the presence of not less than twenty such persons
as the said Sheriff may invite to be present at said
execution.

SEC. 2. And be it enacted, That in the event
of the Sheriff failing to do and execute the crimi-
nal as provided for in the above section first, he
shall forfeit and pay the sum of three hundred
dollars, to be collected as other fines and forfei-
tures are, and the said forfeiture to be paid to the
Inspector of Primary Schools of Frederick coun-
ty, to be applied by them to the general purposes
of education in said county, in their discretion.
