tle, sheep, stage, wagon or carriage from passing
through said gate until they shall have paid the
same; and the rate of tolls for passing through
said gates or using said road one or more times
during twenty-four hours, shall he as follows,
namely: for every score of sheep or hogs, four
cents; for every score of cattle, eight cents; for
every horse and his rider, or led horse, three
cents; for every chair, chaise or vehicle with one
horse, six cents; for every stage, wagon or vehicle
with two horses, twelve cents; for every other
carriage or vehicle with two horses, twelve cents ;
for every other carriage or vehicle, under what-
ever name it may go, the like sum according to
the number of horses drawing the same; for every
cart or wagon whose wheels measure four inches
or more in breadth, three cents for every horse
drawing the same.

SEC. 12. And be it enacted, That every two oxen
used as aforesaid, shall he estimated as equal to
one horse in the charging of said tolls, and every
mule as equal to one horse.

Equalizing toll.
|
|
|
SEC. 13. And be it enacted, That if any per-
son or persons whatever, riding or driving any-
thing whatever, or leading the same, shall there-
with pass through any private gate or bar, or
along or over any private passage-way or other
ground near to and adjoining any turnpike gate,
which shall be erected in pursuance of this act,
with intent to defraud the company, and avoid
the payment of toll for passing through such
gate, or if any person or persons cause the same
to be done, with a view either to lessen or defraud
the company of the toll, and all and every person
so offending directly or indirectly, shall for every
such offence, respectively forfeit and pay to the
said managers, president, and company of the
said road, a sum not exceeding ten dollars, to be
sued for and recovered with costs of suit, before
any justice of the peace, in like manner as debts
of similar amounts, may be sued for and recover-
ed, and if any toll-gatherer shall demand, and
knowingly receive any greater toll than he is
authorised to demand and receive by virtue of this
act, said toll-gatherer shall forfeit ten dollars for
every such offence, for the use of the county in
which said forfeiture shall be incurred.
