CHAPTER 253.

Passed March
2, 1858.

AN ACT to empower the Fire Inspector, com-
missioned by the Mayor of the City of Balti-
more, under an Ordinance of the Mayor and
City Council of Baltimore, to issue summons
for the attendance of witnesses to testify before
him as to the origin and cause of fires occurring
in the city of Baltimore, and in case of refusal
of witnesses to attend, or after attendance re-
fusing to testify, to authorise any justice of the
peace of the State of Maryland, in and for the city
of Baltimore, or any one of the Judges of any of
the Courts for the City of Baltimore, upon appli-
cation of the Fire Inspector to impose a fine
upon such persons so refusing, and authorising
said Justice of the Peace, or Judge, to commit
to prison until fine and costs be paid.

SECTION 1. Be it enacted by the General As-
sembly of Maryland, That the Fire Inspector
commissioned by the Mayor of the city of Balti-
more, under an Ordinance of the Mayor and City
Council of Baltimore, No. four, of the extra ses-
sion of eighteen hundred and fifty-six, and ap-
proved January first, eighteen hundred and fifty-
seven, shall be and he is hereby authorised
whenever in his judgment the occasion demands
it, to issue summons in the name of the State of
Maryland, to any person or persons, requiring
them to attend before him at such time and place
as may be named in such summons, then and
there to testify under oath or affirmation, (which
he is hereby empowered to administer) as to the
origin and causes of any fire occurring in the
city of Baltimore.

SEC. 2. And be it enacted, That such summons
may be directed to any police officer of the city of
Baltimore, or any constable, sheriff or coroner of
the city of Baltimore, who is hereby authorised
to serve the same.
