be paid for as aforesaid, upon his certificate by

the warrant of the Comptroller; Provided, if the
Governor shall he of the opinion on the first day of
July, in the year eighteen hundred and fifty-
nine, that the said company will not he in a con-
dition to furnish and supply the said public build-
ings and grounds with gas light, as aforesaid, by
the first day of January, in the year eighteen
hundred and sixty, then he may, at his discre-
tion, contract upon the terms aforesaid with any
person or persons, or any other corporation, for
gas light, as aforesaid, for the use of the said
public buildings and grounds.

Proviso.

SEC. 9. And be it enacted, That nothing here-
in contained, shall be construed to give to the
said company any hanking privileges, and the
Legislature hereby reserves the right to alter,
amend or repeal the charter hereby created.

Banking pri-
vileges forbid.

SEC. 10. And be it enacted, That this act shall
take effect from the day of its passage.

CHAPTER 215.

In force.

AN ACT to authorise and empower the Primary
School Commissioners, of Howard county, to
lay out and establish a new School District in
said county.

Passed March

6, 1858.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That the County Commission-
ers, of Howard county, be and they are hereby
authorised and empowered to lay out and estab-
lish a new School District in the said Second
Election District in said county, in the same
mode in which the other School Districts of said
county have heretofore been laid out; the said
new School District to include the town of Elys-
ville, and when so laid out and established, the
said new School District shall he upon an equal
footing with, and be entitled to all the rights
