said Circuit Court, subject only to the order of
said court, upon the application of the proper per-
son for the same.
|

SEC. 5. And be it enacted, That the justice of
the peace issuing the warrant hereinbefore autho-
rised, and the sheriff, shall be entitled to receive
the same fees for services under this act, as they
are allowed by law for similar cases, and the per-
sons summoned as jurors to value the damages
sustained, shall each receive one dollar, if de-
manded, for every day he shall attend for that
purpose, which fees and allowances shall be paid
by the School Commissioners of said county.

Compensation.
|

SEC. 6. And be it enacted, That should the levy
of four cents in the hundred dollars, on the asses-
sable property of Baltimore county, authorised by
this act, for the purpose of procuring sites for, and
the erection of school houses in the said county,
yield a larger sum than may be found necessary
for that object, then the excess of such sum shall
be carried by the said School Commissioners, to
the credit of the school fund proper of said
county.

SEC. V. And be it enacted, That this law shall
go into effect from and after the day of its passage.

AN ACT to pay to Ara West, Eleanor Case and
Jane Pennefield, a balance of pension due them
as heirs at law of Hester Pennifield, deceased.

WHEREAS, one Hester Pennefield departed this
life intestate, on the first day of April, in the
year eighteen hundred and fifty-seven, leaving
Ara West, Eleanor Case and Jane Pennefield,
her heirs at law; And whereas, the said deceased
was, at the time of her death, entitled to twen-
ty dollars, as amount of pension then due her
from this State; Therefore,
