and impartially value the damages which the
owners or parties holding an interest therein
will sustain by the use and occupation of said land
for a public school, and it shall be the duty of the
twelve jurors, to inquire into, assess and ascertain
the sum or sums of money to be paid by the said
School Commissioners for the lands condemned for
the use aforesaid, and the said jury shall reduce
their inquisition to writing, and shall sign and
seal the same, and it shall then be returned by
the sheriff to the clerk of the Circuit Court of said
county, and by such clerk filed in his office, and
it shall be confirmed by said court at its next ses-
sion, if no sufficient cause to the contrary be
shown, and when confirmed, shall be recorded by
said clerk at the expense of the said School Com-
missioners; but if not confirmed, the court shall
direct another inquisition in the manner above de-
scribed, if the School Commissioners shall demand
it, and the said inquisition shall describe the prop-
erty taken, giving the bounds of the lands con-
demned, and the quantity and interest valued to
the School Commissioners aforesaid, and such
valuation when paid or tendered to the owner or
owners of such property, or his, her or their legal
representatives, shall entitle the said School Com-
missioners to the use, estate and interest in the
same, thus valued, as fully as if it had been con-
veyed by the owner or owners of the same, and if
such owner or owners reside in the county where
the said piece or parcel of land may lie, and shall
not be under any legal disability to receive the
moneys adjudged, and to give a sufficient discharge
therefor, the said School Commissioners shall pay
or secure to be paid, the damages so adjudged,
before the said piece or parcel of ground shall be
fully condemned for the use of a public school,
and before they shall proceed to occupy the premi-
ses, and to erect a school house thereon; and if the
owner or owners of said piece or parcel of land,
shall reside out of the county, or be under any le-
gal disability, then the said School Commission-
ers shall lodge with the clerk of the circuit court for
said county, the amount of damages adjudged to
the owner or owners of said land, which said sum
of money shall be by the said clerk deposited in
bank, at interest, under the order of the judge for
