houses thereon; to the building of school houses
on ground which may be donated for that object ;
to the purchasing of houses already built and
suitably located, or to the renting or leasing, and
the necessary repairs of the same, and to the de-
fraying of any expense which may be properly in-
cident to the full effectuation of the purposes of
this act.

SEC. 3. And be it enacted, That for the purpose
of diffusing equally, as far as may be practicable,
among the children of said county, the advanta-
ges of Public Schools, the School Commissioners
of said county may themselves, or if they should
deem it more judicious, may appoint a commission
of three or more persons, with the aid of a sur-
veyor, to lay off and divide said county into a
suitable number of school districts, in each of
which they shall locate one public school, and shall
supply at such location a public school house, ca-
pable of accommodating as many scholars as such
school district may be reasonably expected to con-
tain; and in the event of the appointment of a
commissioner and surveyor, to lay off the school
districts, and to locate the school houses herein
provided; the said School Commissioners are hereby
authorised, upon the return of the said commis-
sion and the approval thereof, to pay for such ser-
vice such compensation as they may deem just
and proper; and the said School Commissioners
are hereby further authorised to receive donations
for such sites or locations for school houses as may
be designated, if any be offered, or to purchase
the same and to build thereon school houses in
each of the school districts laid off and approved
by them, or to purchase any house already built,
which may be found suitably located in any of
said school districts, or to rent or lease the same

Proviso.

in their discretion; provided however, that in no
case shall the said commissioners proceed to oc-
cupy any site, and to build school house thereon,
until a good and sufficient title shall have first
been taken for the same, in the corporate name of
the School Commissioners of Baltimore county ;
And provided further, that a larger sum than four
hundred dollars, shall not be expended, for the
building of any school house, or the purchase of
