six feet; and that in case only one or more holder
of real estate, on said street, shall refuse or neg-
lect to have or cause to be paved as herein di-
rected, the board of commissioners, or a majority
of them, shall have full power and authority to
cause such paving to be done; and the expenses
thus incurred shall be levied upon, and collected
out of (as other taxes are levied and collected)
such property respectively in front of which the
commissioners shall have paved.

SEC. 5. And be it enacted, That at the next
regular election of commissioners, (and at every
regular election annually thereafter,) a suitable
person shall be elected by the qualified voters of
said town, to act as bailiff and constable, whose
duties and powers shall be the same as those im-
posed upon and granted to the present bailiff of
Denton.

SEC. 6. And be it enacted, That all acts or
parts of acts inconsistent with this act be, and the
same are hereby repealed.

SEC. 7. And be it enacted, That this act shall
take effect from the date of its passage.

AN ACT to refund to Thomas Gorsuch, of Bal-
timore county, a certain sum of money improp-
erly paid by him into the Treasury of the State.
|

WHEREAS, it appears by the petition of Thomas
Gorsuch, and the evidence accompanying the
same, that he erroneously paid to the late Com-
missioner of the Land office, fifty-nine dollars
and seventeen cents, for confiscated land, held
by him for many years, and which land the
State had been previously paid for: And whereas,
by the act of eighteen hundred and fifty-three,
chapter four hundred and fifteen, section five,
the said Commissioner is allowed a commission
of twenty-five per cent, upon all moneys paid
